STIPULATION AGAINST LIENS
THIS AGREEMENT, made this 28th day of June, one thousand nine
hundred ninety-nine 1999, by and between

DONALD E. DURF and ROSEMARY A. DURF, hereinafter referred to as
OWNER,
WHEREBY the former undertook and agreed to erect and construct
house on that certain lot of ground 58 Ball Park Drive Lot 2,
Plan Book 73-89, Dickinson Township.
NOW THEREFORE, THIS AGREEMENT WITNESSETH, that the said
Contractor, for and in consideration of the sum of One ($1.00)
Dollar to them in hand paid by Owner, the receipt whereof is
hereby acknowledged, and the further consideration mentioned in
the agreement aforesaid, for themselves and their subcontractors,
and all parties acting through or under them, covenant and agree
that no mechanic's liens or claims shall be filed or maintained
by them or any of them against the said buildings and the lot of
ground appurtenant thereto for or on account of any work done or
materials furnished by them or any of them under said contract or
otherwise, for, towards, in or about the erection and
construction of the said buildings on the lot above described,
and the said Contractor, for themselves, their subcontractors and
others under them hereby expressly waive and relinquish the right
to have, file, and maintain any mechanic's liens or claims
against the said buildings or any of them, and agree that this
instrument, waiving the right of lien, shall be an independent
covenant.

of said public road; thence along the latter, South 58 degrees 12 minutes 07 seconds
West, a distance of 199.38 feel to a map nail set 6 feet south of the centerline of said
public road, the Place of BEGINNING.

Cumherland County Recorder of Deads Office In Plan Book 73, Page 89, and being
designated as Lot No. 2 thereon.
BEING THE SAME PREMISES AS TRACT ONE which Paul J. Smith and
Martha E. Smith, his wife, by deed dated 06119198 and recorded
06/24/98 in the Office of the Recorder of Deeds in and for
Cumberland County, Pennsylvania, in Record Book 179-944, granted
and conveyed unto DONALD E. HAWBAKER and SANDY S. SMITH.
