1. Plaintiff, Providian National Bank, is a national banking association located
in Tilton, New Hampshire, and is organized and existing under and by virtue of the laws of
the United States of America.
2. Defendant is an individual whose address is 40 N. Enola Drive, Enola, Cumberland
County, PA 17025.
3. Plaintiff avers that Defendant applied for and was granted credit by First
Union Direct, N.A. upon terms and conditions agreed upon by the parties.
4. Plaintiff avers that thereafter Defendant made purchases and or received cash
advances using said card.
5. On January 30, 1998, First Union Direct N.A.sold, assigned and transferred
to Plaintiff, Providian National Bank, all its right, title and interest in and to the account
between Defendant and First Union Direct N.A., that First Union Direct had the right to
assign the account to Plaintiff and that Plaintiff thus stands in First Union Direct's stead
for the purposes of the instant action.
6. Plaintiff avers that Defendant was notified in writing of the aforesaid assignment,
and Defendant received a new agreement from Plaintiff for said account, a true and correct
copy of which has been attached hereto, marked Exhibit "A" and made a part hereof.
7. Plaintiff avers that in breach of obligations under the Agreement Defendant
failed to make payments as they became due.
8. Plaintiff avers that the terms of the Agreement provide for acceleration of the
entire balance due and owing upon Defendant's breach of the Agreement.
9. Plaintiff avers that the balance due amounts to $6,278.70.

10. Plaintiff avers that interest has accrued at the rate of 21.90% per annum on
the balance due from February 10, 1999.
11. Per the terms of the agreement, the Defendant has agreed to pay to the
Plaintiff as liquidated damages, the costs of collection, including all reasonable attorneys'
fees incurred in the collection of monies owing.
12. Plaintiff avers that pursuant to Plaintiff's agreement with Plaintiff's attorneys,
Plaintiff's attorneys are to receive attorneys' fees of 331/3% of the debt due.
13. Plaintiff believes, and therefore avers, that said attorneys' fees rate is just
and reasonable compensation for the services rendered by said attorneys.
14. Although repeatedly requested to do so by Plaintiff, Defendant has willfully
failed and refused to pay the amount due Plaintiff or any part thereof.
WHEREFORE, Plaintiff demands Judgment against Defendant in the amount
of $6,278.70 with appropriate additional interest, attorneys' fees and costs.
