Neidlinger, of 595 treason Rd., Carlisle, PA 17013 hereinafter referred to as Contractor, AND 19 99 Robert H. Kraybill and Anne C. Kraybill,his wife, of 77 Shady Lane, Carlisle, PA 17013 Owner, whereby the former undertook and agreed to erect and construct a dwelling housetnajter referred to as on that certain lot ofground situate in West Pennsboro Township, Cumberland County, Penna. See attached Exhibit A for description. NOW THEREFORE, THIS AGREEMENT WITNESSETH.• That the said Contractor, for and inconsideration of the sum of(t1.00)Dollar to them in handpaid by Owner, the receipt whereof is hereby acknowledged, and the further consideration mentioned in the agreement aforesaid, for themselves and their subcontractors, and all parties acting through or under them, covenant and agree that no mechanic's liens or claims shall be filed or maintained by them or any of them against the said buildings and the lot of ground appurtenant thereto for or on account of any work done or materials furnished by them or any of them under said contract or otherwise, for, towards, in, or about the erection and construction of the said buildings on the lot above described, and the said Contractor, for themselves, their subcontractors and others under them hereby expressly waive and relinquish the right to have, file, and maintain any mechanic's liens or claims against the said buildings or any of them, and agree that this instrument, waiving the right oflien, shall be an independent covenant. Kutulakis, recorded in the Office of the Recorder of Deeds in and for Cumberland County in Plan Book 79, Page 43, as follows: BEGINNING at an existing bolt set in the centerline of Barnstable Road (T- 447) along lands now or formerly of Mary D. Kutulakis North 77, degrees 23 minutes 05 seconds East a distance of 911.23 feet to an iron pin set, thence along lands now or formerly of Charles B. Strayer, II, South 15 degrees 15 minutes 00 seconds East a distance of 411.40 feet to an iron pin set; thence along lands now or formerly of Richard L. Chamberlain and property now or formerly of Dennis E. Line South 77 degrees 23 minutes 05 seconds West a distance of 836.16 feet to an existing bolt set in the center line of Barnstable Road (T-447) the point and place of beginning. Containing 8.174 acres and being Lot No. 4 on the aforementioned Subdivision Plan. BEING part of the same premises which Robert R. Line, Jr., and Joan P. Line, his wife, granted and conveyed unto Peter N. Kutulakis and Mary D. Kutulakis, his wife, by deed dated October 2, 1965, and recorded in the Cumberland County Recorder of Deeds Office in Deed book 21 T 408. The said Peter N. Kutulakis died August 5, 1997, thereby vesting title in his widow, Mary D. Kutulakis, Grantor herein.
