: CIVIL ACTION - LAW
MOTION TO WITHDRAW AS COUNSEL
AND NOW, TO WIT, this 14th day of January, 2000, comes Daniel F. Wolfson,
Esquire and the law fine of Wolfson 8t Associates, P.C. and files the within Motion for the
following reasons:
1. On or about May 18, 1999, Plaintiff, Action Management, Inc., retained the
law firm of Wolfson at Associates, P.C. to represent them in connection with this and
various other actions.
2. Plaintiff, Action Management, Inc., commenced this action by filing a Complaint
in the Court of Common Pleas of Lebanon County on or about July 9, 1997.
3. The law firm of Wolfson 8L Associates, P.C. has provided extensive services to
Plaintiff, Action Management, Inc., in the above captioned action.
4. That Plaintiff, Action Management, Inc., has repeatedly and severely interfered
with the appropriate operation and proper procedure in litigating this matter, by
interference with the court procedure, as well as, direct communication with the
Defendant, after the retention of counsel.
S. That despite repeated requests by the law firm to cease and desist, Plaintiff has
burdened the law firm with a flood of redundant and often duplicate documentation which
serves no direct purpose in the furtherance of the law firm's representation of the interests
of the Plaintiff in this matter.
6. That despite repeated requests to direct all incoming correspondence and
telephone communications to a specifically designated representative of the law ftrm,
Plaintiff has harassed and badgered numerous employees of the law firm of Wolfson at
Associates, P.C. to the extent that various damage control efforts were required in order to
avoid the loss of highly skilled and qualified staff as a direct result of the repeated
harassment by Plaintiff, Action Management, Inc.
7. That despite numerous requests, Plaintiff, Action Management, Inc., has refused
and continues to refuse to allow counsel the opportunity to appropriately litigate this
matter in the professional manner and fashion that is customary for the law office of
Wolfson 8z Associates, P.C., all to the detriment of the law firm.
8. Due to recent events, communications have broken down between Plaintiff,
Action Management, Inc., and the law firm of Wolfson 8z Associates, P.C. and therefore
counsel's ability to represent Plaintiff has been severely compromised.
2
WHEREFORE, Daniel F. Wolfson, Esquire and the law firm of Wolfson 81
Associates, P.C. requests that they be withdrawn as counsel for Plaintiff, Action
Management, Inc.
