COMPLAINT
AND NOW COMES, the Plaintiff, Howard Hanna Detweiler Realty, by its attorney,
Nicholas & Foreman, P.C., and avers as follows:
1. Plaintiff, Howard Hanna Detweiler Realty, is a Pennsylvania Corporation and a
licensed real estate broker in the Commonwealth of Pennsylvania with principal offices located
at 3310 Market Street, Camp Hill, Cumberland, Pennsylvania 17011.
2. Defendants, Francis J. Beaver and Donna D. Beaver, husband and wife, are adult
individuals residing at 601 Gale Road, Camp Hill, Cumberland County, Pennsylvania 17011.
3. On or about October 26, 1998, Defendants entered into an Exclusive Right To
Sell Agreement For Sale Of Real Estate ("Agreement") with plaintiff, Howard Hanna Detweiler
Realty in which Defendants agreed to list for sale their property at 601 Gale Road, Camp Hill,
Cumberland County, Pennsylvania ("Subject Property") and agreed to allow Plaintiff to attempt
to sell the Subject Property, agreeing that a Six (6%) percent commission would be paid to
Plaintiff if the said property was sold, and further, Defendants agreed that agent's fee would be
protected for prospective buyers after the expiration of the said contract for a period of ninety
(90) days. A true and correct copy of the Agreement is attached hereto, labeled Exhibit "A" and
made a part hereof.
4. Under the Agreement, Plaintiff marketed the Subject Property and attempted to
sell the same, securing an offer to purchase on a Standard Agreement For The Sale Of Real
Estate ("Sales Contract") dated April 28, 1999, in which Plaintiff was the agent for the Seller and
Jack Gaughen Realtor was agent for a prospective buyer being Mr. and Mrs. Robert E. Wright.
A true and correct copy of the Sales Contract is attached hereto, labeled Exhibit "B" and made a
part hereof.
5. Despite obtaining the said prospective buyers and a written offer from the same,
Defendants rejected the same.
6. Plaintiff believes, and therefore avers, that Defendants' failure to accept the said
Sales Contract presented through Plaintiff was an attempt by Defendants to avoid paying the
commission to Plaintiff under the Agreement.
7. Thereafter, during the ninety (90) day protection period for prospective buyers
after expiration of the Agreement, Defendants entered into a contract for sale of the Subject
Property with the aforesaid prospective buyers obtained during the period in which Plaintiff was
marketing the property under the Agreement. A true and correct copy of the Exclusive Buyer(s)
Agency Agreement for sale to the said prospective buyers, dated April 28, 1999, is attached
hereto, labeled Exhibit "C" and made a part hereof.
8. Plaintiff, during its period of exclusive right to sell and marketing, produced and
procured a ready, willing and able buyer with whom Defendants ultimately did enter into a
binding contract of sale.
9. Under the aforesaid Agreement, Defendants, jointly and severally, owe Plaintiff a
six (6%) percent commission on the ultimate sale price of Two Hundred Forty-nine Thousand
($249,000) Dollars or a commission of Fourteen Thousand Nine Hundred Forty ($14,940)
Dollars.
WHEREFORE, Plaintiff' asks judgment against Defendants, jointly and severally, in the
amount of Fourteen Thousand Nine Hundred Forty ($14,940) Dollars together with cost of suit
and interest.

A. POSSESSION: Possession to be granted at settlement unless otherwise indicated. Seller will not enter into or renew any lease for
any term whatsoever during the term of this agency except upon written notice to Agent.
9. AGENCY A TERM: In consideration of Agent's agreement to endeavor to procure a buyer, seller hereby employs agent as the sole and exclusive Agent for the sale of the
aforementioned property and grants Agent the sole and exclusive right to sell the said property, for the price and terms herein mentioned, or for or upon any other price
or terms to which Seller may agree.
This agency shall continue in effect until the "EXPIRATION DATE OF AGENCY" as specified above unless extended in writing by the parties hereto. After the "EXPIRA.
TION DATE OF AGENCY" or any extension thereof, the Agent's authority shall continue as to negotiations pending at time of such expiration.
Seller agrees that if said property is sold or exchanged during the term of said agency, WHETHER EFFECTED BY WHOMSOEVER INCLUDING THE SELLER, Seller
will pay Agent the "AGENTS FEE" and will pay the same fee:
(a) if Agent alone or in cooperation with another agent produces a Buyer ready, willing and able to purchase the property.
(b) if during the "AGENTS FEE PROTECTION PERIOD" the said property is sold or exchanged in whole or in part to anyone to wham Agent, any other Agent. or Seller
Far introduced this property, or otherwise has had negotiations, irrespective of the terms of such sale providing the property is not listed exclusively with another broker
at the time.
In the event Eminent Domain proceedings are instituted against all or part of the subject property during the term of this listing or during the term of any agreement of
safe secured through this agency which would render the property unmarketable to its total state as offered. Seller agrees to pay' Agent's same fee from the gross compensation
received through said proceedings at such time when the said compensation has been recnced by the Seller. Seller agrees that Agent's responsibility to present offers for consider
ation terminates with Sellers acceptance of an offer.
