Stipulation Against Liens
THIS AGREEMENT made the 6th day of July 1999
by and between
Jim Miller Builder, 215 Old York Rd., Dillsburg, PA 17019
hereinafter referred to as Contractor,
AND
Bert and Shelly Wendeln, of 217 Hickory Lane, Shippensburg., PA 17257
Owner, whereby the former undertook and agreed to erect and construct a

NOW THEREFORE, THIS AGREEMENT WITNESSETH: 1$at the said Contractor, for and in consideration of
the sum of ($1.00) Dollar to them in handpaid by Owner, the receipt whereof is hereby
acknowledged, and the further consideration mentioned in the agreement aforesaid for themselves and their
subcontractors, and all parties acting through or under them, covenant and agree that no mechanic's liens or claims
shall be filed or maintained by them or any of them against the said buildings and the lot of ground appurtenant
thereto for or on account of any work done or materials furnished by them or any of them under said contract or
otherwise, for, towards, in, or about the erection and construction of the said buildings on the lot above described,
and the said Contractor, for themselves, their subcontractors and others under them hereby expressly waive and
relinquish the right to have, file, and maintain any mechanic's liens or claims against the said buildings or any of
them, and agree that this instrument, waiving the right of lien, shall be an independent covenant.

ALL THAT CERTAIN tract or parcel of land situate in Middlesex Township, Cumberland
County, Commonwealth of Pennsylvania, more particularly bounded and described as follows, to wit:
BEGINNING at a point lying in rho eastern right-of-way line of Appaloosa Way, a 50.00 foot
wide road, said point also being a corner with Lot #8 as shown on the final subdivision plan of The
Ridings; thence with the line of Lot #8 North 73 degrees 13 minutes 43 seconds East 360.45 feet to a
point, said point being a corner with Lot M8 and the land now or formerly of Donald N. Nyberg; thence
continuing with the line of land now or formerly of Donald N. Nyberg Soutn iu uegrees uu minutes 17
seconds East 92.32 feet to a point, said point being a corner with the land now or formerly of Donald N.
Nyberg and the land now or formerly of John Reber; thence continuing with the line of the land now or
formerly of John Robert South 19 degrees 28 minutes 39 seconds East 347.79 feet to a point, said point
being a corner with the said land of John Rebert and Lot 114 as shown on the hereinafter plan; thence
continuing with the line of Lot 114 South 46 degrees 40 minutes 40 seconds West 318.45 feet to it point,
said point being a corner with Lot K4 and lying in the eastern right-of-way line of Appaloosa Way; thence
continuing with said right-of-way line North 43 degrees 19 minutes 20 seconds West 152.73 feet to point;
thence North 46 degrees 11 minutes 05 seconds West 100.12 feet to a point; thence 157.08 feet along the
arc of a curve to the right, having a radius of 225.00 feet and a delta angle of 40 degrees 00 minutes 00
seconds to a point; thence continuing with said right-of-way line North 03 degrees 19 minutes 20 seconds
West 115.30 feet to a point; thence 93.89 feet along the arc of a curve to the left, having a radius of
400.00 feet and a delta angle of 13 degrees 26 minutes 57 seconds to the point and place of BEGINNING.
CONTAINING 197,399.96 square feet, 4.5317 acres.
BEING known as Lot 7 on the Final Subdivision Plan for The Ridings and recorded in
Cumberland County Plan Book 66, Page 119.
SUBJECT to a 30.00 foot wide bridle, path easement along the eastern boundary line, also subject
to a 33.00 foot wide AT&T and UTS right-of-way and easement running east to west through the
approximate center of the parcel as shown on the final subdivision plan of The Ridings.
UNDER AND SUBJECT, NEVERTHELESS, cc all easements, restrictions, encumbrances and
other matters of record or that which a physical inspection or survey of the premises would reveal.
BEING THE same premises which Taylor Enterprises, Inc., granted and conveyed
unto Bert F. Wendeln and Shelly A. Wendeln, his wife, by deed dated July 6, 1999,
and to be recorded herewith.
