IN THE COURT OF COMMON PLEAS CUMBERLAND COUNTY, PENNSYLVANIA NO: 99- v2oz &Lu e TuA~ CIVIL ACTION MORTGAGE FORECLOSURE COMPLAINT IN MORTGAGE FORECLOSURE Plaintiff, King6sh, L.L.C., brings this action in mortgage foreclosure upon the following cause of action: 1. Plaintiff, King6sh, L.L.C. ("Plaintiff'), is a corporation whose address is c/o Clayton National, Inc, 4 Corporate Drive, 3rd Floor, Shelton, Connecticut 06484. 2. The last known address of Theodore P. Russ and Sandra A. Russ, Defendants is: 2205 Walnut Street, Harrisburg, Pennsylvania 17106. 3. Theodore P. Russ and Sandra A. Russ executed a mortgage with Homestead Savings Association, on July 1, 1998 (the "Mortgage"), in the amount of $50,000.00, which Mortgage was recorded with the Recorder of Deeds of Cumberland County on July 14, 1998 in Miscellaneous Book 910 at Page 256. The Mortgage is a matter of public record and is incorporated herein as provided by Pa. R.C.P. No. 1019(8), A true and correct copy of the Mortgage is attached hereto and marked as Exhibit "A" and is incorporated herein by reference as though fully set forth at length. 4. Homestead Savings Association assigned all right, title and interest in the Mortgage to FGB Realty Advisors Inc., which assignment was recorded in the Recorder of Deeds Office for the County of Cumberland on August 30, 1994, in Mortgage Book 480 at Page 1096. 5. FGB Realty Advisors Inc. assigned all right, title and interest in the Mortgage to Kingfish L.L.C., which assignment was recorded in the Recorder of Deeds Office for the County of Cumberland on April 3, 1996, in Miscellaneous Book 517 at Page 60. 6. Plaintiff is, therefore, either the original Mortgagee named in the Mortgage, the legal successor in interest to the original mortgagee, or is the present holder of the Mortgage by virtue of the above-described assignments. 7. Each Mortgagor named in paragraph 3 above executed a note as evidence of the debt secured by the Mortgage (the "Note"). A true and correct copy of the Note is attached hereto and marked as Exhibit "B" and is incorporated herein by reference as though fully set forth at length. 8. The real property which is subject to the Mortgage is generally known as 850 Bicentennial Drive, Borough of Carlisle, Cumberland County, Pennsylvania (the "Mortgaged Premises"). The legal description of the Mortgaged Premises is attached hereto and marked as Exhibit "C" and is incorporated herein by reference as though fully set forth at length. 9. The interest of each individual Defendant is as Mortgagor, Real Owner or both. 10. If any Defendant above-named is deceased, this action shall proceed against the deceased Defendant's heirs, assigns, successors, administrators, personal representatives and/or executors through his/her estate. 2 11. The Mortgage is in default because the loan evidenced by the Note matured on November 1, 1988 and has not been paid. Accordingly, the whole of the principal, together with the charges specifically itemized below, are immediately due and payable. 12. Interest accrues at a per diem rate of $13.00 for each date after June 30, 1999 that the debt remains unpaid, and Plaintiff may incur additional attorneys' fees and costs as well as other expenses, costs and charges collectable under the Note and Mortgage. 14. Notice of Intention to Foreclose pursuant to 41 P.S. § 403 was not required because the loan evidenced by the Note and secured by the Mortgage has been delinquent and in default for more than twenty-four (24) months under the terms of said loan documents. 15. Notice pursuant to the Homeowner's Emergency Mortgage Assistance Act of 1983, 35 P.S. § 1680.402c, et sea., was not required because the loan evidenced by the Note and secured 3 by the Mortgage has been delinquent and in default for more than twenty-four (24) months under the terms of said loan documents. WHEREFORE, Plaintiff demands judgment against Defendants, Theodore P. Russ and Sandra A. Russ, jointly and severally, for foreclosure and sale of the Mortgaged Premises in the amounts due as set forth in paragraph 12, namely $77,141.07, plus the following amounts accruing after June 30, 1999, to the date ofjudgment: (i) interest at a per diem rate of $13.00; and (ii) additional attorneys' fees hereafter incurred and costs of suit.
