ORDER
AND NOW, this /3' day of 11999, upon consideration of the Petition
pursuant to 42 Pa.C.S. §5326 and good cause shown, it is hereby.
ORDERED that Virginia Calega, M.D., Steve A. Prophet, M.D., Depak Patel, M.D., Jonathan
Whitney, M.D., Venkateash Nadar, M.D., and Tania Hepner, appear for deposition.
It is further ORDERED that the Office of the Prothonotary of Cumberland County, Pennsylvania
shall issue subpoenas directing the above-named witnesses to appear for a deposition and to bring with
them the documents referenced in the subpoenas. The depositions will continue until completed and
will be taken in accordance with the Pennsylvania Rules of Court.

PETITION PURSUANT TO 42 Pa.C.S. 45326
AND NOW, comes the petitioners, Richard J. Katz, M.D., and the George Washington
University, defendants in the above-named action presently pending in the Superior Court for the
District of Columbia, and respectfully petition this Honorable Court for an order directing Virginia
Calega, M.D., Steven A. Prophet, M.D., Depak Patel, M.D., Jonathan Whitney, M.D., Venkateash
Nadar, M.D., and Tania Hepner, to give testimony and/or to produce documents or other things for
use in the matter presently pending in the Superior Court for the District of Columbia. In support of
said Petition, petitioners represent as follows:
1. Petitioners, Richard J. Katz, M.D., and the George Washington University, are interested
defendants in a civil action pending in the Superior Court for the District of Columbia, styled as Olga
Posey and Richard B Posey, as Personal Representatives of the Estate of Patricia A. Posey, Deceased
v Richard J Katz M.D and the George Washington University, Civil Action number 0006578-98.
2. The above named witnesses are Pennsylvania residents and have personal knowledge
of facts relevant and material to the resolution of the claims in the action pending in the District of
Columbia.
On February 18, 1999, petitioners obtained a Commission to take the testimony of the
above-named witnesses issued by the Honorable Joan Zeldon of the Superior Court for the District of
Columbia. Said Commission is attached hereto as exhibit "A".
4. On or about April 26, 1999, Petitioners obtained a second Commission to take the
testimony of the above-mentioned witnesses issued by the Honorable Joan Zeldon of the Superior
Court of the District of Columbia. Said Commission authorizes the Petitioners to take the depositions
of the above-mentioned witnesses during the months of April, May or June, 1999. A true and correct
copy of the aforementioned Order is attached hereto as exhibit "B".
5. On or about May 20, 1999, Petitioners obtained a consent order to extend discovery
in which the Honorable Joan Zeldon of the Superior Court of the District of Columbia extended the
Commission to take testimony dated April 26, 1999, through August 1999. A true and correct copy
of the aforementioned consent order is attached hereto as exhibit "C".
6. The taking of testimony of the above-named witnesses is relevant with respect to the
pending action in the District of Columbia and this Petition is made in good faith to obtain testimony
for purposes of trial. Petitioners respectfully request that the proposed Order be granted directing the
issuance of subpoenas for the taking of the depositions of the above-named witnesses.
Petitioners' counsel has attempted to obtain the depositions of the above-mentioned
deponents amicably and voluntarily without the need to resort to the instant petition to no avail.
8. It is believed, and therefore averred, that all of the individuals/witnesses reside and/or
work in Cumberland County, Pennsylvania.
9. All of the depositions of the witnesses will take place in the offices of Reager & Adler,
P.C. at 2331 Market Street, Camp Hill, Cumberland County, Pennsylvania.
WHEREFORE, petitioners respectfully request that this Honorable Court enter an Order
directing the issuance of subpoenas for the taking of the depositions of Virginia Calega, M.D., Steve
A. Prophet, M.D., Depak Patel, M.D., Jonathan Whitney, M.D., Venkateash Nadar, M.D., and Tania
Hepner for use in a matter pending in the Superior Court of the District of Columbia.
