Wheatland Custom Homes, Contractor, NO. g9•y3a-7 M1-n T_1?-- WHEREAS, McCormick Crossing, of Lancaster, Pennsylvania, is about to execute contemporaneously herewith, a contract with Wheatland Custom Homes of 447 Granite Run Drive, Lancaster, Pennsylvania, for the erection of dwellings upon the lots of land situate as follows: ALL THAT CERTAIN tract of land situate in Monroe Township, County of Cumberland, and Commonwealth of Pennsylvania, being more particularly, being more particularly bounded and described as follows, to wit: BEGINNING at a point in the centerline of Grantham Road (S.R. 2026), said point marking the point of adjoiner of the within described tract, the centerline of Grantham Road, and lands now or formerly of Rosegarden Development; thence departing from the centerline of Grantham Road, and extending along lands now or formerly of Rosegarden Development, South nine (09) degrees six (06) minutes forty-eight (48) seconds East, for a distance of eight hundred eighteen and ninety-six thousandths (818.096) to a pin; thence continuing South nine (09) degrees five (05) minutes thirty-seven (37) seconds East, for a distance of six hundred fifty-two and forty-seven thousandths (652.047) feet to a point on the southeastern side of Granda Flora Drive; thence continuing South nine (09) degrees five (05) minutes thirty (30) seconds East, for a distance of five hundred sixty-nine and two hundred forty-seven thousandths (569.247) feet to lands now or formerly of Donald C. Adams Jr.; thence extending along lands now or formerly of Adams the following three courses and distances: South seventy (70) degrees twenty-two (22) minutes fifty-three (53) seconds West, for a distance of twenty-nine and seven hundred fifty-five thousandths (29.755) feat to a steel pin; thence continuing South one (01) degree thirteen (13) minutes nine (09) seconds West, for a distance of six hundred fifty-one and six hundred twenty-three thousandths (651.623) feet to a pin or point in the bed of the Yellow Breeches Creek; thence extending in and through the bed of the Yellow Breeches Creek, North eighty-six (86) degrees forty (40) minutes twenty- four (24) seconds West, for a distance of eleven hundred ninety-seven and six hundred twenty- one thousandths (1197.621) feet to a steel pin at lands now or formerly of Ashcombe Farm Dairy, Inc.; thence extending along lands now or formerly of Ashcombe Farm Dairy, Inc., North fourteen (14) degrees forty-three (43) minutes three (03) seconds West, for a distance of fifteen hundred forty-nine and seventy-eight hundredths (1549.78) feet to a steel pin at Lot No. 7 of Duffield Crossing-Phase I; thence extending along Lots No. 7 and 8 of Duffield Crossing-Phase I, North seventy-six (76) degrees twenty-eight (28) minutes ten (10) seconds East, for a distance of seven hundred sixty-two and three hundred fifty-four (762.354) feet to a steel pin at Lot No. 13; thence extending along Lots No. 13 and No. 10, North twelve (12) degrees fifty-six (56) minutes seventeen (17) seconds West for a distance of four hundred sixty- four and twenty-four thousandths (464.024) feet to a steel pin at Lot No. 2; thence extending along Lot No. 2 South seventy-six (76) degrees twenty-eight (28) minutes ten (10) seconds West, for a distance of one hundred ten and three hundred thirty-nine thousandths (110.339) feet to a steel pin at Lot No. 4; thence extending along Lot No. 4, North twelve (12) degrees fifty-six (56) minutes seventeen (17) seconds West, for a distance of four hundred thirty-eight and twenty-three thousandths (438.023) feet to a pin or point in the centerline of Grantham Road; thence extending in and through the centerline of Grantham Road, North seventy-six (76) degrees twenty-eight (28) minutes ten (10) seconds East, for a distance of three hundred forty-nine and seven hundred seventy-five thousandths (349.775) feet to a pin set in the centerline of Grantham Road at lands now or formerly of Rosegarden Development, said pin making the place of BEGINNING. CONTAINING Lots No. 1, 2 and 10 through 32, as all those lots of Duffield Crossing -Phases II, III and IV. BEING THE SAME premises which Harry H. Fox, Jr., a married man, by his deed dated the '74'1 day of '11, IL , 1999 and to be recorded simultaneously herewith, granted and conveyed unto McC rmick Crossing, MORTGAGOR herein. iI I NOW, the I q 7 day of J << l 1999, at the time of and immediately before the execution of the principal contr ct, and before any authority has been given by the said McCormick Crossing, to the said Wheatland Custom Homes to commence work on the said building, or purchase materials for the same in consideration of the making of the said contract with Wheatland Custom Homes and the further consideration of One Dollar, to Wheatland Custom Homes paid by McCormick Crossing, it is agreed that no lien shall be filed against the building by the contractor, or any sub-contractor, nor by any of the material men or workmen or any other person for any labor, or materials purchased, or extra labor or materials purchased for the erection of said building, the right to file such liens being expressly waived. - 2 - WITNESS, our hand and seals the day and year aforesaid.
