McCOY BROTHERS, INC., Contractor IN THE COURT OF COMMON PLEAS OF CUMBERLAND COUNTY, PENNSYLVANIA NO. 99 - Y.36,? M L-D STIPULATION AGAINST LIENS WHEREAS, DAVID M. MELOY and ERICA VOSS MELOY, husband and wife, of 35 Leah Street, Dillsburg, PA 17019, hereinafter called "Owners" are about to execute contemporaneously herewith a contract with McCOY BROTHERS, INC. of 217 Pine Road, P.O. Box D, Mt. Holly Springs, PA 17065, hereinafter called "Contractor" for the erection, construction, alteration or repair of a building and other improvements upon the property and real estate known as 100 North walnut Street, Mechanicsburg, Cumberland County, Pennsylvania, more particularly described in a Deed dated November 24, 1998 and recorded December 16, 1998 in Deed Book 191 at Page 117, Cumberland County records. NOW THEREFORE, it is stipulated and agreed between the parties, as part of the contract and in further consideration thereof, that neither the Contractor or any subcontractor or materialmen, nor any person furnishing labor and materials under the contract or any supplemental contract, may file a lien, commonly called a Mechanics' Lien, under the contract or any supplemental contract, oral or written, for work done or materials furnished, such right being expressly waived. Contractor warrants and represents that no work of any kind has been done and no materials have been furnished, delivered or ordered in connection with the contract or any supplemental contract for extra work. Contractor further agrees to indemnify Owner from any and all damages, costs and expenses, including reasonable attorney's fees suffered by Owner as a result of any lien filed or claim asserted against the property by Contractor, or any subcontractor, materialmen, workmen or any other person in violation of this stipulation.
