STIPULATION AGAINST LIENS
THIS AGREEMENT made this /
day of 1999 b and
between Bryant G. Minnich, A Sole Proprieto hip, hereinafter
referred to as Contractor,
AND
William S. Diehl, Jr, and Tamara L. Diehl, husband and wife,
hereinafter referred to as Owners, whereby the contractor
undertook and agreed to erected and construct a dwelling on the
certain lot of ground situate in Penn Township, Cumberland County,
Commonwealth of Pennsylvania, and more fully described in Exhibit
"A" which is attached hereto and made a part hereof known as 2115
Pine Road, Newville, Dickinson Township, Cumberland County, PA.
NOW THEREFORE, THIS AGREEMENT WITNESSETH: That the said
Contractor, for an in consideration of the sum of ($1.00) Dollar
to Contractor in hand paid by owner, the receipt whereof is hereby
acknowledged, and the further consideration mentioned in the
agreement aforesaid, for itself, himself or themselves and its,
his or their subcontractors, and all parties acting through or
under them, covenant and agree that no mechanics liens or claims
shall be filed or maintained by them or any of them against the
said buildings and the lot of ground appurtenant thereto for or on
account of any work done or materials furnished by them or any of
them under said contract or otherwise, for, towards, in, or about
the erection and construction of the said buildings on the lot
above described, and the said Contractor, for itself, himself or
themselves, its, his or their subcontractors and others under
them, hereby expressly waive and relinquish the right to have,
file, and maintain any mechanic's liens or claims against the said
buildings or any of them, and agree that this instrument, waiving
the right of lien, shall be an independent covenant.

Exhibit A
ALL that certain tract or parcel of land and premises, situate, lying and being in the
Township of Penn in the County of Cumberland and Commonwealth of
Pennsylvania, more particularly bounded and described as follows:
IN accordance with a subdivision for Donald L. Keiter dated August 16, 1990
prepared by Charles R. Cook, Surveyor, recorded in Cumberland County Plan
Book 62, Page 123, to wit:
BEGINNING at a point marked by a P.K. nail in the centerline of the Pine Road
(L.R. 21008) at corner of Lot No. 5 on the aforesaid subdivision plan; thence along
the lineof Lot No. 5, North 03 degrees 31 minutes 56 seconds West 318.33 feet to a
pin; thence along Lot No. 1, North 86 degrees 28 minutes 04 seconds East 150.00 feet
to a pin in the corner of Lot No. 7; thence along Lot No. 7 South 03 degrees 31
minutes 56 seconds East 318.33 feet to a P.K. nail in the centerline of the Pine Road;
thence along the centerline of the Pine Road, South 86 degrees 28 minutes 04
seconds West 150.00 feet to a P.K. nail, the point and place of BEGINNING.
BEING Lot No. 6 on the aforementioned Plan and containing 1.10 acres more or
less.
BEING the same premises which William S. Diehl a/k/a William S. Diehl, Jr. and
Tamara L. Diehl, husband and wife, by Deed dated December 17,1993, which Deed
is recorded in the Office of the Recorder of Deeds in and for Cumberland County in
Deed Book 36-5, Page 66, granted and conveyed to William S. Diehl, Jr. and
Tamara L. Diehl„ husband and wife, Borrowers herein.
