RICHARDSON, Owner, of 2 North Pin Oak Drive, Boiling Springs, PA 17007, entered into a contract with S. & A. CUSTOM BUILT HOMES, INC., Contractor, of Carlisle, Pennsylvania, to provide materials and perform labor necessary for the construction of a residential dwelling upon a tract of land situate in Dickinson Township, Cumberland County, Pennsylvania, more particularly bounded and described as follows: SEE ATTACHED EXHIBIT "A" NOW, THEREFORE, it is hereby stipulated and agreed by and between the said parties, as part of the said contract and for the consideration therein set forth, that neither the undersigned Contractor, any subcontractor or material man, nor any other person furnishing labor or materials to the said Contractor under his contract, shall file a lien, commonly called a mechanics' lien, for work done or materials furnished to the said building, improvements or any part thereof. THIS STIPULATION is made and intended to be filed with the Cumberland County Prothonotary within ten (10) days after date, in accordance with the requirements of Act of Assembly of Pennsylvania, in such case provided. Mentzer; thence along the southern line of Ritner Highway (U.S. Route 11), North 580 18' 321' East a distance of 20 feet to a point at the northwest corner of lands now or formerly of Richard E. and Marie W. Weary, South 010 00' 42" West a distance of 243.80 feet to an existing limestone monument at lands now or formerly of Fry's Farm Fresh Eggs, Inc.; thence along the same, South 530 16' 47" West, a distance of 170.17 feet to a point at the southeast corner of Lot No. 5, which is now or formerly of Thomas E. Kramer; thence along the same, North 310 41' 28" West, a distance of 218.01 feet to a point at the southwest corner of lands now or formerly of Bradley A. and Cynthia A. Mentzer; thence along the same, North 570 50' 34 East, a distance of 100.16 feet to a point; thence along the same, North 140 03' 34" East a distance of 20.22 feet to a point; thence along the same, North 310 34' 20" West, a distance of 248.81 feet to an existing rebar, the place of BEGINNING. CONTAINING 1.255 acres, more or less. BEING Lot No. 4 as shown on the Preliminary/Final Subdivision Plan for Thomas E. Kramer and Marilyn M. Kramer, as prepared by Brad Douglas Pontz, R.S., dated May 12, 1997 and recorded in Cumberland County Plan Book 74, Page 139. UNDER AND SUBJECT to the restrictions of record in Cumberland County Deed Book "X", Vol. 19, Page 446. AND SUBJECT also to the restrictions that only one accessory building can be constructed on the subject premises, which building shall not exceed one story in height and the exterior of which shall be constructed in a manner harmonious with the dwelling house thereon erected and said accessory building to be kept in a good state of repair. BEING the same premises which Marilyn M. Heck by her deed dated September 29, 1998, and recorded in the Office of the Recorder of Deeds, in and for Cumberland County, Pennsylvania, in Deed Book 186, Page 87, granted and conveyed to Christopher G.
