COMPLAINT
1. The Plaintiffs are Clyde Winter and Shirley Winter who reside at 848 Lake Nelson
Lane, Arrington, VA 22922-2719.
2. On information and belief, Defendant BARBCO is a Pennsylvania Corporation with a
principal place of business at 1013 Mumma Road, Wormleysburg, PA 17043.
3. On or about April 2, 1987, in consideration of and as security for a loan in the amount
of $175,000.00 extended to Defendant by Clyde and Shirley Winter, Defendant executed a Bond
and Warrant and Mortgage in favor of Clyde and Shirley Winter in the amount of $175,000, with
the Bond and Warrant payable in monthly installments of principal and interest. A true and
correct copy of this Bond and Warrant is attached hereto as Exhibit "A".
4. In consideration of the loan, the Defendant executed a mortgage in favor of Clyde and
Shirley Winter on the premises, C&S Mobile Home Park, Mountain Street, Mount Holly
Springs, PA, which mortgage was recorded of record in the Cumberland County Recorder of
Deeds Office on June 6, 1987, in Mortgage Book 858, page 765. A true and correct copy of the
mortgage is attached hereto as Exhibit "B".
5. Defendant filed a Chapter 1 I Bankruptcy petition on or about December 8, 1992.
6. Under the confirmed Chapter 11 Plan of Defendant, the balance due Plaintiffs under
the Bond and Warrant in the amount of $168,422.07, together with capitalized interest arrears in
the amount of $14,315.87, was to be amortized beginning October 1, 1993 for 25 years at the rate
of 6% per annum.
7. The property secured by and subject to the mortgage is described in the legal
description contained within the mortgage.
8. The Defendant is in default of the mortgage as Defendant has failed to make multiple
monthly payments of principal and interest due beginning October 1, 1993 and thereafter. By the
terms of the mortgage, upon default of the payments for a period of one month, the entire
principal and all interest due thereon are collectible.
9. The following amounts are due on the mortgage:
Principal Balance:
$173,635.22
Interest arrears at 6% per annum: 6,035.61
Costs of suit, title search:
$600.00
Attorneys' Fees (5% of unpaid balance): $8,681.76
TOTAL
$188,952.59
10. The attorneys' fees set forth above are in conformity with the mortgage documents
and Pennsylvania law, and will be collected in the event of a third party purchase at sheriffs sale.
If the mortgage is reinstated prior to the sale, reasonable attorneys' fees and costs will be charged.
11. Plaintiffs have given Defendant notice of this breach and have declared all sums
secured by the mortgage to be immediately due in a letter dated May 12, 1999, a true and correct
copy of which is attached hereto as Exhibit "C.
WHEREFORE, Plaintiffs demand judgment in mortgage foreclosure in their favor and
against Defendant in the amount of $188,952.59, together with interest at the rate of 6% per
annum and other expenses incurred by the Plaintiffs which are properly chargeable in accordance
with the terms of the mortgage, and for the foreclosure and sale of the mortgaged property.

ALL THOSE THREE (3) CERTAIN tracts of land situate in the Borough of Mount Holly
Springs, Cumberland County, Pennsylvania, bounded and described as follows,
TRACT NO. le BEGINNING at an iron pipe on the eastern right-of-way line
of the Reading Company Railroad, and on line of lands NIP of Hempt Brothers,
Inc.i thence along lands H/P of Hempt Brothers, Inc., along the fenceline,
South 39 degrees 25 minutes 50 seconds East 440.70 feet to an iron pin on
the northwestern edge of a 20 foot allay, thence along the northwestern line
of said 20 foot alley, South 47 degrees 45 minutes West 698.45 feet to an
iron pin on the northern line of another 20 foot alley leading from Mountain
Street; thence along the northern line of said 20 foot alley leading from
Mountain Street, North 62 degrees 15 mintuee West 174.57 feet to an Iron
pipe on the eastern right of way line of said Reading Railroad Company; thence
along the eastern right of way line of said Reading Company Railroad North
28 degrees 15 minutes East eight hundred twenty-seven and twenty-nine hundredths
(827.29) feet to an iron pipe, the Place of BEGINNING. CONTAINING 4.787 acres,
more or lees.
The above description is in accordance with a survey prepared by Thomas Alvin
Neff, R.S•, dated November 11, 1977, as revised August 21, 1981.
The first distance of 440.70 feet was incorrectly indicated as 484.74 in a
prior deed.
TRACT NO. 2s BEGINNING at an iron pipe at the northwest side of Mountain
Street end the north side of a 20 feet wide public alley; thence along the
northern aide of said alley, North 62 degrees 15 minutes West 203.8 feet to
tire East aide of a 20 feet wide public alley; thence along said last mentioned
public alley, North 47 degrees 45 minutes East 129.4 feet to a points thence

As you know, our office represents Clyde and Shirley Winter in the above
referenced matter.
Allow this letter to serve as notice that your client is in default under the terms
of the Bond and Warrant dated April 2, 1987 and the Mortgage dated April 2, 1987.
As a result, my clients are demanding all sums due and payable in addition to all
interest in arrears, costs of suit, and attorney's fees in the amount of 59£, of the
