WHEREAS, Owners are about to execute contemporaneously herewith, a
contract with Contractor for the construction of a residential dwelling
Upon Lot No. 49 as shown on the Final Subdivision Plan of Hickory Ridge,
Phase II, said premises being more particularly described on Exhibit "A"
attached hereto and made a part hereof.
NOW, 2"7 , 1999, at the time of and immediately before
execution of t principal contract, and before any authority has been
given by the said Owners to Contractor to commence construction, or
purchase materials for the same in consideration of the making of the said
contract with Contractor and the further consideration of one Dollar to
Contractor paid by owners it is agreed that no lien shall be filed against
said real estate or improvements erected thereon by the contractor, or any
subcontractor, nor by any of the materialmen or workmen or any other person
for any labor, or materials purchased, or extra labor or materials
purchased for the said construction, the right to file such liens being
expressly waived.

ALL THAT CERTAIN piece or parcel of land situate in the Township of East Pennsboro, Cumberland
County, Commonwealth of Pennsylvania, being more fully described as follows:
BEGINNING at a point said point being located on the dedicated right-of-way line of Kent Drive at the
dividing line of Lot No. 581, Highlands of Hampden Square, Phase 2, Planbook 57, Page 144A and
Lot no. 49, HickoryRidge, Phase 11, Plan Book 77, Page 142. Thence by said right-of-way line, North
18 degrees 53 minutes 28 seconds West a distance of 80.00 feet to a point on the dividing line of Lot
No. 48 and Lot No. 49, herein described. Thence by said dividing line, North 71 degrees 06 minutes
32 seconds East a distance of 125.00 feet to a point on the dividing line of Lot No. 50 and Lot No. 49,
herein described. Thence by said dividing line, South 18 degrees 53 minutes 28 seconds East a
distance of 80.00 feet to a point on the dividing line of Lot No. 581, Highlands of Hampden Square,
Phase 2, Plan Book 57, Page 144A and Lot No. 49, herein described. Thence by said dividing line,
South 71 degrees 06 minutes 32 seconds West a distance of 125.00 feet to a point, the place of
BEGINNING.
BEING Lot No. 49, containing 10,000.00 sq. ft., as shown on Final Subdivision Plan of Hickory Ridge,
Phase II, recorded in Plan Book 77, Page 142, and being subject to all easements of record.
