STIPULATION AGAINST LIENS
WHEREAS, Donald A. Wheatley and Kathy A. Wheatley, his wife, the OWNER of the real estate
described below, has or is about to execute a contract with D & K Quality Homes, Inc., whose principal
place of business 336 Charles Road, Mechanicsburg, Pennsylvania, to construct a single family dwelling
upon lands situate at Lot #8 East Carrington Court, Mechanicsburg, Cumberland County, Pennsylvania, and
more particularly bounded and described on Exhibit "A" attached hereto and made a part hereof; and,
NOW, THEREFORE, this 27" day of July, 1999, before any authority had been given by D & K
Quality Homes, Inc. to commence work on said facilities, or purchase materials for same, in consideration of
making of the above-described Contract with Donald A. Wheatley and Kathy A. Wheatley, his wife, Owner,
and in further consideration of One ($1.00) Dollar paid to the general contractor by Donald A. Wheatley and
Kathy A. Wheatley, his wife, the receipt whereof is hereby acknowledged, it is agreed that no liens or claims
shall be filed or maintained against the Owner's facilities and the land above-described, or upon Donald A.
Wheatley and Kathy A. Wheatley, his wife, the Owner, by the general contractor, or any of its
subcontractors, or by any of the materialmen or workmen, or any other person acting through or under
them, for or on account of any labor, or materials purchased, or extra labor or materials purchased for,
towards, in or about the erection, construction, design and improvement of said facilities, under said
contract or otherwise, the right to have, file and maintain such liens or claims against the facilities, the land
above-described, and Donald A. Wheatley and Kathy A. Wheatley, his wife, the Owner, being hereby
expressly waived by the general contractor for itself, its subcontractors, all materialmen, or workmen and
other acting through or under them.
IN WITNESS WHEREOF, each of the parties by their duly authorized representatives have hereunto
executed the Stipulation Against Liens this 27" day of July, 1999.

bounded & described as follows, to wit:
Beginning at a point on the northern right of way line of
Carrington Court East at the southwest corner of Lot #7;
thence along said right of way line by a curve to the right,
said curve having a radius of 25.00 feet & a arc distance of
19.62 feet to a point; thence along the same & along a 20'
Sewer Lateral Easement by a curve to the left, said curve
having a radius of 125.00 feet & a are distance of 55.39 feet
to a point being the northeast corner of Lot #9; thence
along Lot #9 & through a 20' Sewer Lateral Easement
N57-12-43W 118.26 feet to a point at lands N/F of Franklin
R. & Joyce Roth: thence along said lands & along a 20' Sewer
Lateral Easement N39-39-33E 111.56 feet to a point being the
northwest corner of Lot #7; thence along Lot #7 539-19-33E
123.95 feet to a point, being the place of beginning.
Containing 11,086 Sq. Ft.
