CIVIL ACTION - LAW
COMPLAINT
AND NOW comes the Plaintiffs, Howard L. R. Clausen and Patricia A.
Clausen, by and through their attorney, Leslie D. Jacobson, and avers as follows:
1. Howard L. R. Clausen is an adult individual who resides at 2100 Cedar Lane,
Enola, PA 17025. Patricia A. Clausen is an adult individual who resides at
2100 Cedar Lane, Enola, PA 17025.
2. Robert L. Shuey is an adult individual whose last known address is 9 Oak
Ridge Road, Carlisle, PA 17013. Joanne E. Shuey is an adult individual
whose last known address is 9 Oak Ridge Road, Carlisle, PA 17013.
3. Defendant Jack Gaughan Realtor, having a place of business at 1068
Harrisburg Pike, Carlisle, PA 17013, is named as escrow holder only.
4. On or about March 23, 1999, Howard L. R. Clausen and Patricia A. Clausen,
herein known as "Plaintiffs", and Robert L. Shuey and Joanne E. Shuey,
herein known as "Defendants", executed a Standard Agreement for the Sale
of Real Estate, herein known as "Agreement", which is incorporated herein
and referenced hereto as Exhibit "A".
5. On the Agreement dated March 23, 1999 between Plaintiffs and
Defendants, Plaintiffs are listed as "Sellers" and the Defendants are listed as
"Buyers".
6. The Agreement between Plaintiffs and Defendants is for the sale of Plaintiff's
property located at 2100 Cedar Lane, Enola, PA 17025.
7. The agreed selling price in the Agreement for the Plaintiff's property located
at 2100 Cedar Lane, Enola, PA 17025 between the Plaintiffs and Defendants
is $ 208,000 (Two-hundred,eight-thousand dollars).
8. According to the terms of the Agreement, Defendants provided a $ 5,000.00
(Five thousand dollar) deposit on the date the Agreement was signed, March
23, 1999. Said deposit is being held in escrow by Jack Gaughan Realtor.
9. According to the terms of the Agreement, settlement was to be made on or
before June 30, 1999.
10. On June 30, 1999, all parties appeared for settlement, however Defendants
refused to complete the Agreement for the sale of Plaintiff's home at 2100
Cedar Lane , Enola, PA 17025.
COUNT I: BREACH OF CONTRACT - LIQUIDATED DAMAGES
11. Paragraphs 1-10 are incorporated by reference herein.
12. Plaintiffs are entitled to Defendant's $ 5,000.00 (Five-thousand dollar)
deposit, as liquidated damages, because of Defendant's breach of the
Agreement.
WHEREFORE, Plaintiffs request this Honorable Court to grant Plaintiffs
Judgment in their favor in the amount of $ 5,000.00 (Five-thousand dollars), and
order Jack Gaughan Realtor, escrow holder, to turn over said funds.
COUNT II: BREACH OF CONTRACT - ACTUAL DAMAGES
13. Paragraphs 1-12 are incorporated by reference herein.
14. At the time of the date of settlement, Plaintiffs were in the process of
moving into their new home located at 85 Pine Street, Dillsburg, PA 17019.
15. The completion of Plaintiff's relocation to 85 Pine Street, Dillsburg, PA
17019 was contingent on Defendants completion of the Agreement, the
purchase of Plaintiff's home at 2100 Cedar Lane, Enola, PA 17025.
16. Plaintiffs incurred the following expenses due to Defendant's breach of the
Agreement:
(A) Costs of moving back to $ 1584.00
2100 Cedar Lane, Enola, PA 17025 from
85 Pine Street, Dillsburg, PA 17019
(Estimate attached as exhibit "B")
(B) Appliances bought for property at 1122.49
85 Pine Street, Dillsburg, PA 17019
(Invoice attached as exhibit "C")
(C) 50 Gallons of heating oil for property at 39.50
85 Pine Street, Dillsburg, PA 17019
(Invoice attached as exhibit "D")
(D) Expenses for moving into the property at 1177.00
85 Pine Street, Dillsburg, PA 17019 which was
done in anticipation of completion of Agreement.
(Includes rentals, fuel, mileage on personal vehicles,
and meals for moving help. This outline is attached
as exhibit "E")
(E) Pool supplies 150.00
(F) Septic clean out 350.00
(G) Utilities activation 174.00
(H) Items broken during move 225.00
(1) Wages lost from time off for moving 2520.00
(Outline of individuals, hours and rate
attached as exhibit "F")
(J) Fish to stock pond 300.00
TOTAL EXPENSES $ 7641.99
17. Plaintiffs are entitled to recover $ 7641.99(Seven-thousand,six-hundred-
forty-one dollars and ninety-nine cents), alternatively, as actual damages.
WHEREFORE, Plaintiff requests this Honorable Court to grant Plaintiffs Judgment in
the amount of $ 7641.99 (Seven-thousand,six-hundred-forty-one dollars and
ninety-nine cents.)

failing to remove their belongings from the premises by the time and date of settlement and by
otherwise failing to satisfy their obligations under the Agreement. All other averments of fact
contained in paragraph ten (10) are specifically denied, and strict proof thereof is demanded at
trial.

NEW MATTER PURSUANT TO Pa.R.C.P. No. 2252(d)

The averments of fact contained in the Answers to the Complaint and the Defendants
New Matter above are hereby incorporated by reference and are made part of this New Matter
Pursuant to Pa.R.C.P. No. 2252(d) to the Complaint of the Plaintiffs.

Defendants, Robert L. Shuey and Joanne E. Shuey, assert this New Matter pursuant to Pa.
R. C. P. No. 2252(d) and thereby join Defendant Jack Gaughen Realtor as an Additional
Defendant in this action on the following basis:
23.
On or about June 13, 1999, Detendants Shuey were contacted by a real estate agent of
Additional Defendant, regarding the possibility of Plaintiffs being given an extension of time
under the Agreement of Sale to enable them to complete the removal of their possessions and
belongings.

24.
Defendants Shuey decided not to agree to an extension of additional time, and instead
requested that the parties abide by their original Agreement and complete settlement on or before
June 30, 1999.
25.
Based on the original agreement and the decision of Defendants Shuey, settlement was
mutually scheduled for 1:00 p.m., June 30, 1999.
26.
Additional Defendant's agent assured Defendants Shuey that Plaintiffs would be
completely moved out of the subject premises by l 1:30am on June 30, 1999, which was the time
scheduled for the pre-settlement walk through inspection.
27.
At no time prior to June 30, 1999, did Additional Defendant, through its agents or
employees, notify or inform Defendants Shuey that Plaintiffs would be unable to remove their
belongings and possessions from the subject premises by 11:30 a.m. on the date of settlement.
28.
To the contrary, Additional Defendant, by and through its agents and employees,
consistently told Defendants Shuey that the Plaintiffs would have their belongings and
possessions removed from the subject premises by 11:30 a.m. on June 30, 1999, and that
exclusive possession of the subject premises would be given to the Defendants Shuey at
settlement scheduled for 1:00 p.m. on June 30, 1999.

The Defendants Shuey arrived at the subject premises for the pre-settlement walk through
inspection at 11:30am on June 30, 1999, however, a significant portion of Plaintiffs' possessions
and belongings were not yet removed from the subject premises.
30.
Defendants Shuey were thereby unable to conduct a proper walk through inspection of
the subject premises. A copy of the Pre-Settlement Walk-Through Inspection form indicating
that the premises were not vacant is attached hereto and incorporated herein by this reference as
Exhibit "A."
31.
Upon information and belief, Additional Defendant, by and through its agents or
employees, failed to notify Plaintiffs that they were required to remove their possessions and
belongings from the subject premises by the time and date of settlement.
32.
Upon information and belief, Additional Defendant, by and through its agents or
employees, failed to notify Plaintiffs that Defendants Shuey were expecting the subject premises
to be available for proper inspection at 11:30 a.m. on June 30, 1999.
33.
Upon information and belief, Additional Defendant, by and through its agents or
employees, failed to inform Plaintiffs that Defendants Shuey had refused to grant Plaintiffs an
extension of additional time in order to meet their contractual obligations under the Agreement
of Sale.

If Plaintiffs establish that they suffered injuries and damages as alleged in their
Complaint, which allegations answering Defendants specifically deny, said injuries and damages
were caused solely by the negligence, recklessness and carelessness of Additional Defendant,
Jack Gaughen Realtor, its agents, servants, or employees, by their acts and omissions as
described in the preceding paragraphs.
35.
As a result of the aforesaid actions and omissions, Additional Defendant, Jack Gaughen
Realtor, is solely liable to Plaintiffs for any alleged injuries and damages they may have suffered.
36.
If as a result of the matters alleged in Plaintiffs' Complaint, Defendants are held liable to
Plaintiffs for all or part of such injuries or damages as they may have sustained, Additional
Defendant is the party primarily liable for such injuries and damages, and is liable over to
Defendant by way of contribution or indemnification, for all such damages as may be required to
pay to Plaintiffs.
37.
In the alternative, if as a result of the matters alleged in Plaintiffs' Complaint, Defendants
are held liable to Plaintiffs for all or part of such injuries or damages as they may have sustained,
Additional Defendant is jointly and severally liable to Plaintiffs based upon the foregoing
allegations for such injuries and damages, and is liable over to Defendants by way of
contribution for all such damages Defendants may be required to pay to Plaintiffs.

As a result of the same transactions and occurrences upon which Plaintiffs' cause
of action is based, Additional Defendant is liable directly to Defendants in that as a result of the
negligence, recklessness and carelessness of Additional Defendant, Jack Gaughen Realtor, its
agents, servants, or employees, by their acts and omissions as described in the preceding
paragraphs, Defendants Shuey suffered the following expenses and damages:
a. Costs of Porch Furniture $ 2,385.03
b. Wages lost from time taken for settlement (Robert) $ 182.50
C. Wages lost from time taken for settlement (Joanne) $ 88.35
d. Application Fee charged by Lending
Institution and not refunded $ 325.00
e. Title Search Fee S 1,290.94
f. Application fee for Home Equity Loan $ 124.50
g. Difference in interest rate between the loan secured
on subject premises at 6.75% and interest rate secured
on purchase of another home at 7.875% resulting in
$56.25 additional interest each month for 15 years $10,125.00
h. Interest lost on $5,000.00 deposit since 6/30/99 $ 900.00
WHEREFORE, Defendants Robert L. Shuey and Joanne E. Shuey respectfully request
that this Honorable Court:
a. Enter a judgment in their favor and against Additional Defendant, Jack Gaughen
Realtor, as solely liable in this matter, if there is any liability to Plaintiffs;
b. Enter a judgment over and against Additional Defendant, Jack Gaughen Realtor,
by way of indemnification or contribution for the amount recovered by Plaintiffs against
Defendants, together with costs, in the event that a verdict is recovered by Plaintiffs; and

C. Enter a judgment in its favor and against Additional Defendant, Jack Gaughen
Realtor, for damages as alleged above
COUNTERCLAIM
39.
The averments of tact contained in the Answers to the Complaint and the Defendants'
New Matter are hereby incorporated by reference and are made part of this Counterclaim to the
Complaint of the Plaintiffs.
40.
On or about June 13, 1999, Plaintiffs requested an extension of time under the Agreement
of Sale to enable them to complete the removal of their possessions and belongings from the
subject premises.
41.
Defendants Shuey did not agree to an extension of additional time, and instead requested
that the parties abide by their original Agreement and complete settlement on or before June 30,
1999.
42.
On or about June 30, 1999, the final date of settlement permitted under the Agreement,
Defendants Shuey arrived at the subject premises at 11:30 a.m. for the pre-settlement walk
through inspection only to discover that Plaintiffs had not removed their belongings and
possessions.

43.
Given the significant amount of belongings and possessions which still remained at the
subject premises, Defendants Shucy were thereby unable to conduct a complete and proper walk
through inspection at that time.
44.
Through their failure to remove their belongings and possessions from the subject
premises by the date and mutually scheduled time of settlement, Plaintiffs were unable to fulfill
their contractual obligation to transfer exclusive possession of the subject property to Defendants
Shuey on the date and time set forth in the Agreement of Sale.
45.
The Defendants did agree to conduct the pre-settlement walk through inspection at a later
time in the afternoon on June 30, 1999, upon their belief that the Plaintiffs were in fact
completely moved out of the subject premises.
46.
However, upon arrival at the subject premises for this rescheduled pre-settlement walk
through inspection, Defendants Shuey discovered that the subject premises was not vacant and
Plaintiffs were still not completely out of the home.
47.
Defendants Shuey were therefore unable to do a complete and adequate pre-settlement
walk through inspection.
48.
Defendants Shuey did attempt a partial walk through inspection and discovered that there
were various items that were not in substantially the same condition as they were at the time of
the signing of the Agreement of Sale.
49.
Plaintiffs were not only unable to surrender exclusive possession on the date and time of
settlement but were also unable to transfer the subject premises in the same condition as it was at
the time of the signing of the Agreement.
50.
Plaintiffs breached the Agreement of Sale through their negligence, carelessness and
recklessness in failing to remove their possessions and belongings from the subject premises by
the date agreed to in the Agreement of Sale.
51.
At all relevant dates and times prior to the discovery of Plaintiffs' breach on June 30,
1999, Defendants Shuey were willing and prepared to satisfy and discharge their contractual
obligations under the Agreement.

As a result of the Plaintiffs' knowing and intentional failure to remove their possessions
and belongings from the subject premises by June 30, 1999, thereby breaching their obligations
under the Algeement of Sale, Defendants Shuey suffered the following expenses and damages:
a. Costs of Porch Furniture
b. Wages lost from time taken for settlement (Robert)
C. Wages lost from time taken for settlement (Joanne)
d. Application Fee charged by Lending

off to the extent that Plaintiffs' judgment exceeds Defendants' recovery on their claim.
