WHEREAS, Mark L. Butler, of Carlisle, Cumberland County, Pennsylvania, is about to
execute contemporaneously herewith, a contract with CUSTER HOMES, INC., of 1309 Laurel Point
Circle, Harrisburg, Pennsylvania 1711 Q for the erection of a two story brick traditional home upon
a lot of land situate in, West Pennsboro Township, Cumberland County, Pennsylvania, being
designated as Lot no. 13 on a Plan for Lee K. Finkenbinder. See Exhibit "A".
NOW, rq, ?U.i ?? 1999, at the time of and immediately before
execution of the principal contract, and before any authority has been given by the said Mark L.
Butler, to commence work on the said building, or purchase materials for the same in consideration
of the making of the said contract with CUSTER HOMES, INC., and the further consideration of
One Dollar to CUSTER HOMES, INC., paid by Mark L. Butler, it is agreed that no lien shall be filed
against the building by the contractor, or any sub-contractor, nor by any of the material men or
workmen or any other person for any labor, or materials purchases, or extra labor or materials
purchased for the erection of said building, the right to file such liens being expressly waived.
WITNESS, our hand(s) and seal(s) the day and year aforesaid.

Pennsylvania being more fully bounded and described in accordance with a plan prepared by Larry
V. Neidlinger, RPLS dated March 10, 1999, and recorded in the Office of the Recorder of Deeds for
Cumberland County in Plan Book , Page
BEGINNING at a point in centerline of PA route 641 at lands now or formerly of Lee K.
Finkenbinder shown on Plan as Lot No. 1; thence along lands now or formerly of Lee K.
Finkenbinder and passing through an iron pin set in concrete North 01 degrees 35 minutes 49
seconds East 1120.00 feet to an iron pin; thence still along Lot No. 1 of said Plan South 88 degrees
24 minutes 11 seconds East 400.00 feet to an iron pin; thence still along lands now or formerly of
Lee K. Finkenbinder South 01 degrees 35 minutes 49 seconds West 1124.31 feet to a point in
centerline of PA Route 641; thence along centerline of PA Route 641 34 minutes 34 seconds West
309.44 feet to a point; thence still along centerline of PA Route 641 North 88 degrees 30 minutes
09 seconds West 90.59 feet to a point, the place of BEGINNING.
CONTAINING 10.2992 acres, more or less, and being designated as Lot No. 13 on a Plan for Lee
K. Finkenbinder.
