WHEREAS, Brian E. and Kimberly A. Tanner- Tetkoskie Owners, are about
to execute contemporaneously herewith, a contract with The McNaughton
Company for the construction of a residential dwelling on Lot 136, Hastings
Drive, Hampden Township, Cumberland County PA said premises being more
particularly described on Exhibit °A" attached hereto and made a part
hereof.
NOW, A`1"? C , 1999, at the time of and immediately before
execution of the principal contract, and before any authority has been
given by the said Owners to Contractor to commence construction, or
purchase materials for the same in consideration of the making of the said
contract with Contractor and the further consideration of One Dollar to
Contractor paid by owners it is agreed that no lien shall be filed against
said real estate or improvements erected thereon by the contractor, or any
subcontractor, nor by any of the materialmen or workmen or any other person
for any labor, or materials purchased, or extra labor or materials
purchased for the said construction, the right to file such liens being
expressly waived.

ALL THAT certain piece, parcel or lot of land situate in Upper Allen Township, Cumberland
County, Pennsylvania, and bounded and described as follows:
BEGINNI ?1G at a point on the Northern right-of-way line of Hastings Drive (50,00 feet
wide), said point being located at the Southeastern corner of Lot No. 137; then along the
Eastern boundary line of Lot No. 137 North 32 degrees 49 minutes 35 seconds East, and
through a125.00 foot wide drainage easement, for a distance of 131.74 feet, to a point In
line of other lands now or formerly of The McNaughton Company; then along said lands
now orfb? mercy of The McNaughton Company, and along the centerline of said 25.00 foot
wide draloage easement, South 51 degrees 04 minutes 00 seconds East, for a distance
of 98.91 f et, to a point at the Northwestern corner of Lot No. 135; then along the Western
boundary line of Lot No. 135, and through said 25.00 foot wide drainage easement, South
38 degre s 56 minutes 00 seconds West, for a distance of 130.00 feet, to a point on the
Nort hern fight-of-wayline of Has
Drive (50.OOfeet wide); then along said right-of-way
line Nort h 51 degrees 04 minutes 00 seconds West, for a distance of 66.28 feet, to a point
on the ar i of a circle curving to the left, having a radius of 175.00 feet, and an arc length
of 18.65 fbet to a point and the place of BEGINNING.
This piec¢, parcel or lot of land consists of approximately 11,960 square feet of land, and
is known and numbered as Lot No. 136 on the Final Subdivision Plan for Canterbury
Estates, hases VII and VIII, which is recorded in Cumberland County in Plan Book 77,
