WAIVER OF RIGHT TO FILE MECHANICS' LIENS
i
WHEREAS, VITO IANNUZZI and SUZANNE M. IANNUZZI, Owner, of
123 Meals Drive, Carlisle, PA 17013, entered into a contract with
ELDON MARTIN t/d/b/a ELDON MARTIN BUILDER, Contractor, of
Chambersburg, Pennsylvania, to provide materials and perform
labor necessary for the construction of a residential dwelling
upon a tract of land situate in West Pennsboro Township,
Cumberland County, Pennsylvania, more particularly bounded and
described as follows:
SEE ATTACHED EXHIBIT "A"
NOW, THEREFORE, it is hereby stipulated and agreed by and
between the said parties, as part of the said contract and for
the consideration therein set forth, that neither the undersigned
Contractor, any subcontractor or material man, nor any other
person furnishing labor or materials to the said Contractor under
his contract, shall file a lien, commonly called a mechanics'
lien, for work done or materials furnished to the said building,
improvements or any part thereof.
THIS STIPULATION is made and intended to be filed with the
Cumberland County Prothonotary within ten (10) days after date,
in accordance with the requirements of Act of Assembly of
Pennsylvania, in such case provided.
IN WITNESS WHEREOF, the said parties hereto, intending to be
legally bound hereby, have hereunto set their hands and seals

LEGAL DESCRIPTION
ALL that certain tract of land situate in West Pennsboro
Township, Cumberland County, Pennsylvania, being described as Lot
No. 5 and 6A in the Subdivision for Fieldstone, as prepared by
Stephen G. Fisher, R.S. dated January 15, 1990, and last revised
and recorded in Cumberland County Plan Book 60, Page 27, and more
fully bounded and described as follows:
BEGINNING at a railroad spike set in the dedicated right-of-way
of Crossroads School Road (T-438) at the dividing line between
Lots Nos. 6 and 6A on the hereinabove mentioned subdivision plan;
thence along said dividing line North 790 26' 29" West 350.25
feet to a point; thence continuing along the dividing line
between Lot 5 and Lots 6 and 5A on said plan, South 120 43' 31"
West 284.72 feet to a pin; thence along lands now or formerly of
Robert E. Rhoades, II, North 770 161 2911 West 170.00 feet to a
point; thence along same South 130 49' 261' West 75.78 feet to a
point; thence along lands now or formerly of Charles A. Motter,
North 680 32' 58" West 170.84 feet to a point; thence along same
North 210 27' 02" East 466.49 feet to an iron pin; thence along
the dividing line between Lots 5 and 9 on said plan South 510 59'
07" East 187.88 feet to an iron pin; thence along the dividing
line between Lots 5 and Lots 7 and 8 on said plan South 790 26'
29" East 450.00 feet to a point in the dedicated right-of-way of
Crossroads School Road; thence within said right-of-way South 120
43' 31" West 50.04 feet to a point, the place of BEGINNING.
CONTAINING 3.1205 acres exclusive of dedicated right-of-way.
BEING the same premises which Jeffrey S. Austin and Mary B.
Austin, and Lettermen, Inc. by their deed dated August (o , 1999
and recorded in the office of the Recorder of Deeds in and for
Cumberland County, Pennsylvania, in Deed Book , Page
granted and conveyed to Vito Iannuzzi and Suzanne M. Iannuzzi,
Mortgagors herein.
