WHEREAS, ERNEST A. JONES, JR. and JACQUELINE JONES of 926 Willcliff Drive,
Mechanicsburg, Pennsylvania, is about to execute contemporaneously herewith, a contract, with Carlson
Construction, Inc. of 1085 Country Club Road, Camp Hill, Pennsylvania, for the erection of a building upon
premises commonly known as LOT P-12 CHERISH DRIVE, EAST PENNSBORO TWP. CAMP HILL,
CUMBERLAND County, Pennsylvania, as set forth in the deed dated June 8, 1999, recorded at Deed Book
201, Page 437, in the Recorder's Office for CUMBERLAND County, Pennsylvania, as more specifically
described in Exhibit "A" which is incorporated herein and attached hereto.
NOW, JUNE 9, 1999, at the time of and immediately before the execution of the principal contract,
and before any authority has been given by the said Owner to the said Contractor to commence work on the
said building, or purchase materials for the same in consideration of the making of the said contract with
Contractor and the further consideration of One Dollar ($1.00), to Contractor paid by Owner, it is agreed that
no lien shall be filed against the building by the Contractor, or any subcontractor, nor by any of the
materialmen or workmen or any other person for any labor, or materials purchased, or extra labor or materials
purchased for the erection of said building, the right to file such liens being expressly waived.
WITNESS, our hands and seals the day and year aforesaid.

ALL THAT CERTAIN piece or parcel of land situate in East Pcnnsboro Township, Cumberland
County, Pennsylvania, more particularly bounded and described as follows, to wit:
BEGINNING at a point on the western right-of-way line of Cherish Drive, at the line of Lot No.
P-11, on the hereinafter mentioned Plan of Lots; thence along said dividing line South 78 degrees 52
minutes 14 seconds West, 158.43 feet to a point, at the line of lands now or formerly of Edward N.
McClune Estate; thence along the eastern line of lands now or formerly of Edward N. McClune Estate
North 11 degrees 27 minutes 25 seconds West, 77.39 feet to a point; thence continuing along the same
North I I degrees 07 minutes 23 seconds West, 64.37 feet to a point at the line of Lot No. P-13 on the
hereinafter mentioned Plan of Lots; thence along said line South 83 degrees 57 minutes 40 seconds East,
180.27 feet to a point at the western right-of-way line of Cherish Drive; thence along the western right-of-
way line of Cherish Drive by a curve to the left having a radius of 300.00 feet and an arc length of 89.89
feet to a point at the northern line of Lot No. P-1 I, the point and place of BEGINNING.
CONTAINING 19,011.05 square feet.
BEING Lot No. P-12, on the Final Plan of Floribunda Heights, Phasc 11, Section VIII, revised
February 6, 1997 and recorded in the Office of the Recorder of Deeds, Cumberland County, in Plan Book
74, Page 33.
