COMPLAINT
Plaintiff, Harrisburg Glass Co., by and through its counsel, Goldberg, Katzman &
Shipman, P.C., alleges the following in support of this Complaint:
Plaintiff is Harrisburg Glass Co. (Harrisburg Glass), a Pennsylvania Corporation
with an address of 444 Railroad Avenue, P.O. Box 3250, Shiremanstown, Cumberland County,
Pennsylvnia 17011.
2. Defendant is Central Pa. Builders, Inc. (Central Pa. Builders) a Pennsylvania
Corporation with an address of 6355 Baeshore Road, Mechanicsburg, Cumberland County,
Pennsylvania 17055.
On or about January 27, 1999, Harrisburg Glass and Defendant entered into a
contract whereby Harrisburg Glass agreed to provide and install two glazed aluminum entrance
doors and associated products, as well as twelve (12) glazed aluminum thermal fixed window
framings and associated products in return for $10,114.00. The specific goods and services
contracted for are described more full in the contract attached hereto as Exhibit "A" and
incorporated by reference.
4. Harrisburg Glass has completely performed all aspects of its contractual
relationship with Defendant (described in Exhibit "A" hereto).
5. Defendant has failed to perform its contractual obligations in that it has not paid
the $10,114.00 owed to Harrisburg Glass for the goods and services provided.
6. Defendant's failure to pay for the goods and services provided by Harrisburg Glass
constitutes a breach of the contract attached hereto as Exhibit "A."
Defendant is indebted to Harrisburg Glass in the amount of $10,114.00. A bill
submitted to Defendant demanding such payment is attached hereto as Exhibit "B," the terms of
which are incorporated by reference.
8. Payment was due thirty (30) days from the date of invoice, March 10, 1999.
9. Harrisburg Glass is entitled to a finance charge of 1.5% for every month the
amount due and owing is not paid in full. See Exhibit "B."
10. Harrisburg Glass is entitled to 25% of the amount due and owing, plus court costs,
as a collection fee since it has had to engage counsel to collect the amount outstanding. See
Exhibit "B."
11. Harrisburg Glass is entitled to a continuing finance charge of 1.5% per month until
payment in full is received.
12. Despite Harrisburg Glass' demands, Defendant continues to fail to pay the
amounts due and owing.
13. Harrisburg Glass demands the following in liquidated damages, plus all court costs,

per the contractual agreement and invoices agreed to by Defendant:
Invoice Amount: $10,114.00
Finance Charge (1.5% per month, 4 months as of writing): $620.64
Collection Fees (25% of invoice): $2528.50
TOTAL (exclusive of costs and continuing finance charge): $13,263.14
WHEREFORE, Plaintiff Harrisburg Glass Co. demands that the Court enter judgment in
its favor and against Defendant Central Pa. Builders in the amount of $13,263.14 plus costs of
court and the continuing finance charge of 1.5% per month. This amount is below the arbitration
limit for Cumberland County.
