PENNSYLVANIA STIPULATION AGAINST LIENS WHEREAS, DARRELL C. DETHLEFS, the OWNER of the real estate described below, has or is about to execute a contract with RON TROSTLE NEW HOMES AND REMODELING CONTRACTOR, INC., whose principal business address is 494 RIDGE ROAD, YORK SPRINGS, PA 17372 , to construct a single family dwelling upon lands situate at LOT //21, ALLEN ESTATES, MECHANICSBURG, CUMBERLAND COUNTY, PENNSYLVANIA, and more particularly bounded and described on Exhibit "A" attached hereto and made a part hereof; and, NOW, THEREFORE, this ~'~_ day of ~r'.~(,,,j , 2003, before any authority had been given by RONTROSTLE NEW HOMES~,ND REMODELING CONTRACTOR, INC. to commence work on said facilities, or purchase materials for same, in consideration of making of the above-described Contract with DARRELL C. DETHLEFS, Owner, and in further consideration of One ($1.00) Dollar paid to the general contractor by DARRELL C. DETHLEFS, Owner, the receipt whereof is hereby acknowledged, it is agreed that no liens or claims shall be filed or maintained against the Owner's facilities and the land above-described, or upon DARRELL C. DETHLEFS, the Owner, by the general contractor, or any of its subcontractors, or by any of the materialmen or workmen, or any other person acting through or under them, for or on account of any labor, or materials purchased, or extra labor or materials purchased for, towards, in or about the erection, construction, design and improvement of said facilities, under said contract or otherwise, the right to have, file and maintain such liens or claims against the facilities, the land above-described, and DARRELL C. DETHLEFS, the Owner, being hereby expressly waived by the general contractor for itself, its subcontractors, all materialmen, or workmen and other acting through or under them. IN WITNESS WHEREOF, each of the,.~rties by their,~d, uly authorized representatives have hereunto executed the Stipulation Against Liens this 4~ day of -ti ~ , 2003. ,~ CONTRACTOR: Ron Trostle General Contractor EXHIBIT 'A' ALL THAT CERTAIN tract or parcel of land situate in the Township of Lower Allen, County of Cumberland, Commonwealth of Pennsylvania more particularly bounded and described as follows to wit: BEGINNING at a point on the western right-of-way line of Glenfinnan Place (60 feet wide) at the dividing line between Lots Nos. 20 and 21 as shown on the hereinafter mentioned plan; thence along the western right-of-way line of Glenfinnan Place South 22 degrees 15 minutes 00 seconds West a distance of 230.00 feet to a point; thence by a curve, curving to the right having a radius of 15.00 feet and an arc length of 23.56 feet to a point on the northern right-of-way line of Wellgate Lane (60 feet wide); thence along the northern right-of-way line of Wellgate Lane North 67 degrees 45 minutes 00 seconds West a distance of 145.00 feet to a point at the dividing line between Lots Nos. 21 and 22; thence along the dividing line between Lots Nos. 21 and 22 North 22 degrees 15 minutes 00 seconds East a distance of 180.00 feet to a point; thence continuing along the same North 02 degrees 38 minutes 43 seconds West a distance of 71.66 feet to a point at the dividing line between Lots Nos. 20, 21 and 22; thence along the dividing line between Lots Nos. 20 and 21 South 67 degrees 45 minutes 00 seconds East a distance of 190.17 feet to a point on the western right-of-way line of Glenfinnan Place, said point being the place of BEGINNING CONTAINING 40,132.09 square feet. BEING Lot No. 21 as shown on the Final Subdivision Plan of Allen Estates. Said plan being recorded in Plan Book 72, Page 125. BEING part of the same premises which Banzer Corporation, a Pennsylvania corporation, by Deed dated Janua.ty 3, 1996 and recorded April 15, 1996 in the Office of the Recorder of Deeds. in and for Cumberland County, Pennsylvania, in Deed Book 137, Page 614, granted and conveyed unto Penn Valley Corporation, a Pennsylvania corporation, the Grantor herein.
