STIPULA TIONA GAINST LIENS
THIS AGREEMENT made the J?/Iday of July , 1999, by and between,
JAMES M. GUYER, of 34 Hassinger Road, Newburg, Pennsylvania, hercinafler referred to as
Contractor,
AND
TYLER S. WATSONand WANDA A. WATSON, ol'45 (filbert Road, Shippensburg, Pennsylvania,
hereinafter referred to as Owners,
WHEREAS, the said Contractor undertook and agreed to make certain improvements to
Owner's property situate in the Township of Southampton, Cumberland County, Pennsylvania,
known as Lot 1, Crestwood Acres West, Shippensburg, Pennsylvania, more fully described in
Exhibit "A" attached hereto and made it purl hereof.
NOW THEREFORE, "THIS AGREVIVIENT WITNESSETI I: That the said Contractor, for
and in consideration of the sum of One Dollar ($1.111)) to said Contractor in hand paid by Owner, the
receipt whereof is hereby acknowledged, and the further consideration mentioned in the agreement
aforesaid, for himself, and his subcontractors, and all panics acting through or under them, covenant
and agree that no mechanic's liens or claims shall be filed or mainnined by them or any of them
against the said buildings and improvements and the lot of ground appurtenant thereto for or on
account of any work done or materials furnished by them or any, of then under said contract or
otherwise, for, towards, in, or about the erection Land construction of the said improvements on the
lot above described, and the said Contractor, liar himself, his subcontractors and others under him
hereby expressly waive and relinquish the right to have, file, and maintain any mechanic's liens or
claims against the said buildings or may of them, and agree that this instrument, waiving the right of
lien, shall be an independent covenant.

ALL-THAT CERTAIN piece or parcel of land, situate in the
Township of Southampton, County of Cumberland, Pennsylvania,
referred to as Lot No. 1, more particularly bounded and described
in accordance with Subdivision Plan entitled "Land Subdivision of
Crestwood Acres Nest", prepared by earl D. pert, Professional Land
surveyor, which Subdivision Plan has been approved by the
appropriate municipal authorities and is recorded in Cumberland
County Plan Book 66, Page 144, as follows:
BEGINNING at a railroad spike at common corner of
Lots 1 and 2 on the above referred to Subdivision Plan,
which railroad spike is also in Public Road T-323 (Walnut
Dale Road)? thence along Walnut Dale Road and along line
of land now or formerly of Harry A. Doyle, sr., North
eighty-seven (87) degrees nine (09) minutes zero (00)
seconds East, one hundred fifty and zero hundredths
(150.00) feet to a set railroad spike at the corner, of
the within described lot and other lands now or formerly
of Randy G. Shuman; thence along other lands now or
formerly. of Randy S. Shuman and Lot 1, South three (03)
degrees thirty-five (35) minutes zero (00) seconds East,
five hundred eighty-five and five hundredths (585.05)
feet to an iron pin at common corner of other lands now
or formerly of Randy S. Shuman and Lot 1 and in line of
land now or formerly of Alan J. Anthony; thence along I
common boundary lines of other lands now or formerly of
wian J. Anthony, Lot 1 and Lot 12, South eighty-seven
(87) degrees nine (o9) minutes zero (00) seconds west,
one hundred fifty-seven and five hundredths (157.05) feet
to a concrete monument at Common Corner or Lots 1, 12,
and V thence along line of Late 1 and 2, North two (2)
degrees fifty-three (53) minutes thirty-five (35),seconds
West, five hundred eighty-five and zero hundredths.
(585.00) feet to the point and place of BEGINNING.
CONTAINING a total area of 2.061 acres, more or less, in
accordance with the above referred to subdivision plan.
UNDER AND SUBJECT to dedicated right-of-way line, building
setback lines, storm water detention easement and other notations
and conditions contained on the above referred to Subdivision Plan.
ALSO UNDER AND SUBJECT to the following restrictions which
shall be covenants running with the land and which shall be binding
upon the grantees and their heirs, successors and assigns:
1. Only single family detached residential structures and
appurtenant accessory buildings (garage, horse barn,
etc.) shall be constructed on each lot.
2 Tha•primary use of each lot shall be residential, but
lots may also be utilized as secondary or accessory uses
(as those terms are understood under the Municipalities
Planning Code and Zoning Ordinances) for home occupations
or professional offices and such non-residential uses
shall not be noxious or offensive to neighbors or
neighboring properties.
3. No mobile homes are permitted on any lot in this
subdivision.
4. Double vide mobile home structures are permitted on lots
in this subdivision, but only with permission of the

unreasonably or withis hheld designee. hd will ber within + 15 days of
submission.
5. All residential structures shall have a minimum of 1000
sq. ft. of finished living floor area.
6. No lots in this subdivision shall be further subdivided
at any time in the future, so as to increase the total
number of lots.
7. No unlicensed vehicles, junk yards or junk cars are
