STIPULATION AGAINST MECHANIC'S LIEN
CLAIMS AND NO-LIEN CONTRACT
WHEREAS, THE HUDSON GROUP, INC., herein (whether
individual, partnership or corporation) called CONTRACTOR, has
entered into a written contract with HUDSON HOLDING COMPANY, a
Pennsylvania Limited Partnership dated July 7, 1999, herein
(whether singular or plural) called OWNER, to provide materials
and perform labor necessary in the erection of a commercial
structure upon which a Mortgage is being placed through Sky
Bank, its successors or assigns, as Mortgagee and which land is
situate in the Borough of Lemoyne, Cumberland County,
Pennsylvania described as follows:
ALL THAT CERTAIN tract of real estate situate in the Borough of
Lemoyne, Cumberland County, Pennsylvania, bounded and described
as follows:
BEGINNING at a point at the southeastern corner of Lot 1-A
depicted on the Preliminary/Final Subdivision Plan for
Bridgeview Office Center, Hempt Bros., Inc., prepared by H.
Edward Black and Associates, P.C. dated May 4, 1999, last
revised June 11, 1999 which point of beginning is located the
following three courses and distances from the eastern line of
Lowther Street at the northeast corner of lands now or later of
Career Com Corp: (1) south 50 degrees 57 minutes 05 seconds ?
east 996.8 feet; (2) south 50 degrees 36 minutes 53 minutes
east 268.06 feet; and (3) south 75 degrees 25 minutes 06
minutes east 88.47 feet to the place of beginning; THENCE along,
lands now or late of J. Barry Miner, Christopher Miner and J.
Barry Miner south 75 degrees 25 minutes 06 seconds east 325.20 sp
feet to a point at lands now or ]ate of Franklin H. Sostar,
THENCE north 97 degrees 51 minutes 29 seconds east 908.39 feet.,;
to a point at lands now or late of Consolidated Rails,;+ '
Corporation; THENCE by a curve to the left having a radius
1,780.00 feet a length of 227.17 feet to a point; THENCE stil$1'}'

54 degrees 47 minutes 26 seconds west 170.18 feet to a point

the northeastern corner of Lot 1 as shown on the aforesaid
subdivision plan; THENCE along same south 35 degrees 12 minutes
34 seconds west 410.63 feet to a point on the right of way line
of Susquehanna Court as depicted on said subdivision plan;
THENCE along same by curve to the right having a radius of
60.00 feet a length of 103.16 feet to a point; THENCE south 35
degrees 12 minutes 34 seconds west 26.03 feet to a point, the
place of BEGINNING.
NOW THEREFORE it is hereby stipulated and agreed by and
between CONTRACTOR AND OWNER as part of said contract for the
consideration therein set forth, that neither the aforesaid
CONTRACTOR, nor any subcontractor or materialman, nor any other
person, firm or corporation, furnishing labor or materials to
said CONTRACTOR under said contract, or extra labor and
material in the construction of said addition, shall file a
lien commonly called a mechanic's lien for work done or
materials furnished to said building or any part thereof, the
right to file such lien being hereby waived.
CONTRACTOR and OWNER do hereby declare and represent that
no machinery, materials or work of any kind whatsoever have
been placed, done, delivered to, or performed upon the above-
described premises prior hereto by CONTRACTOR, or by any
person, firm or corporation acting for it or at its instance or
request.
THIS STIPULATION, WAIVER AND NO-LIEN CONTRACT is executed
and is intended to be filed in the Office of the Prothonotary
of Mercer County, Pennsylvania, within ten (10) days after date
in accordance with the Acts of Assembly of Pennsylvania in such
cases provided.
