STIPULATION AGAINST LIENS
THIS AGREEMENT made this 164 day of &z, 1991, by and
between Terry S. Leiby & Son, of Carlisle, Cumberlan County,
Pensylvania, hereinafter referred to as Contractor,
AND
Daryl L. Hurley and Jennifer, L. Hurley, husband and wife,
hereinafter referred to as owners, whereby the contractor
undertook and agreed to erected and construct a dwelling on the
certain lot of ground situate in Penn Township, Cumberland County,
Commonwealth of Pennsylvania, and more fully described in Exhibit
"A" which is attached hereto and made a part hereof known as Lot
#34 Maple Grove, Penn Township, Cumberland County, PA.
NOW THEREFORE, THIS AGREEMENT WITNESSETH: That the said
Contractor, for an in consideration of the sum of ($1.00) Dollar
to Contractor in hand paid by owner, the receipt whereof is hereby
acknowledged, and the further consideration mentioned in the
agreement aforesaid, for itself, himself or themselves and its,
his or their subcontractors, and all parties acting through or
under them, covenant and agree that no mechanic's liens or claims
shall be filed or maintained by them or any of them against the
said buildings and the lot of ground appurtenant thereto for or on
account of any work done or materials furnished by them or any of
them under said contract or otherwise, for, towards, in, or about
the erection and construction of the said buildings on the lot
above described, and the said Contractor, for itself, himself or
themselves, its, his or their subcontractors and others under
them, hereby expressly waive and relinquish the right to have,
file, and maintain any mechanic's liens or claims against the said
buildings or any of them, and agree that this instrument, waiving
the right of lien, shall be an independent covenant.

ALL THAT CERTAIN TRACT OF LAND SITUATE IN Penn Township,
Cumberland County, Pennsylvania, bounded and described as follows in
accordance with a Final Subdivision Plan for Maple Grove (Phase 2), recorded in
the Office of the Recorder of Deeds in and for Cumberland County in Plan Book 79,
Page 80, to wit:
BEGINNING at a point on the Southern side of Fox Hollow Lane, on the dividing
line between Lots 15 and 16 on the above mentioned Final Subdivision Plan thence
by said dividing line, South 02 degrees 30 minutes 16 seconds East, 551.81 feet to a
point; thence by the land now or formerly of Linwood B. Phillips, Jr., and E. Lucille
Phillips, North 82 degrees, 48 minutes 32 seconds West, 102.86 feet to a point
marked by an existing planted stone; thence by land now or formerly of M. Thomas
Sheaffer, North 02 degrees 30 minutes 16 seconds West, 244.20 feet to a point; thence
by the same, North 85 degrees 55 minutes 12 seconds West 88.21 feet to a point
marked by an existing iron pin; thence by other land now or formerly of the
Grantors, being Lot 6 or Maple Grove Phase 1, North 04 degrees 04 minutes 48
seconds East 300.00 to a point marked by an existing iron pin; thence by the
Southern side of Fox Hollow Lane, South 85 degrees 55 minutes 12 seconds East,
155.65 feet to a point, the Place of BEGINNING.
CONTAINING 1.7662 acres and being Lot No. 15 on the above mentioned Final
Subdivision Plan.
BEING the some premises which Wilbert L. Diehl and Rodger C. Diehl, Jr., doing
business as Maple Grove, a PA Partnership, granted and conveyed to Daryl L.
Hurley and Jennifer L. Hurley, husband and wife, Borrowers herein.
