at the intersection of the Southeastern side of Reesers Road and the Southwestern side
of St. John's Drive, Hampden Township, Cumberland County, Pennsylvania, being all of
Lot No. 1 and the Eastern 20 feet of Lot No. 2, Block B, shown on a plan of St. John's
Place, Plan Book 5, page 36, Cumberland County Records, and being more fully bounded
and described according to a plan of survey, by Michael C. D'Angelo, Professional
Land Surveyor, dated August 20, 1980 and bearing drawing.No. 34-129, as follows, to
wit:
BEGINNING at a point on the Southwestern side of St. John's Drive (formerly
Brides Row - 50.00 feet wide .right-of-way), said point being measured by a curve
to the left having a radius of 30.00 feet for an arc length of 58.09 feet from a point
on the Southeastern side of Reesers Road (50.00 feet wide right-of-way); thence
extending from said beginning point and along the Southeastern side of St. John's
Drive, South 60 degrees 28 minutes 40 seconds East, 117.01 feet to a hub found at
a corner of Lot No. 23 of the abovementioned plan; thence extending along said lot,
South 50 degrees 30 minutes 00 seconds West, 62.49 feet to a point at other lands of
Lot No. 2 of the above mentioned plan; thence extending along same, North 39 degrees
30 minutes 00 seconds West, 150.00 feet to a hub found on the Southeastern side of
Reesers Road, aforesaid; thence extending along same, North 50 degrees 30 minutes 00
seconds East, 76.39 feet to a point of curve at the intersection of Reesers Road
and St. John's Drive; thence along a curve to the right, having a radius of 30.00 feet,
for an arc length of 58.09 feet to the first mentioned point and placed BEGINNING.

THE FOLLOWING NOTICE IS BEING PROVIDED PURSUANT TO THE
FAIR DEBT COLLECTION PRACTICES ACT, 15 U.S.C. §1601:
The undersigned attorney is attempting to collect a
debt owed to the Plaintiff, and any information
obtained will be used for that purpose. The amount
of the debt is stated in this Complaint. Plaintiff
is the creditor to whom the debt is owed. Unless
the Debtor, within thirty (30) days after your
receipt of this notice disputes the validity of the
aforesaid debt or any portion thereof owing to the
Plaintiff, the undersigned attorney will assume
that said debt is valid. If the Debtor notifies
the undersigned attorney in writing within the said
thirty (30) day period that the aforesaid debt, or
any portion thereof, is disputed, the undersigned
attorney shall obtain written verification of the
said debt from the Plaintiff and mail same to

1. Plaintiff, UNION PLANTERS BANK, N.A. F/K/A LEADER
FEDERAL SAVINGS AND LOAN ASSOCIATION, is a corporation with an
address of P.O. Box 1860, memphis, Tennessee 38101.
2. Defendant, JAMES W. SAUVE, JR., is an adult individual
whose last known address is 282 ST. JOHNS DRIVE, CAMP HILL,
PENNSYLVANIA 17011. Defendant, JUDITH A. SAUVE, is n adult
individual whose last known address is 282 ST. JOHNS DRIVE, CAMP
HILL, PENNSYLVANIA 17011.
3. On or about September 4, 1980, the said Defendants
executed and delivered a Mortgage Note in the sum of $93,000.00
payable to VNB MORTGAGE CORPORATION, which Note is attached
hereto and marked Exhibit "A".
4. Contemporaneously with and at the time of the execution
of the aforesaid Mortgage Note, in order to secure payment of the
same, Defendants made, executed, and delivered to original
Mortgagee, a certain real estate Mortgage which is recorded in
the Recorder of Deeds office of the within County and
Commonwealth in Mortgage Book 683, Page 126 conveying to original
Mortgagee the subject premises. The Mortgage was subsequently
assigned to LEADER FEDERAL SAVINGS AND LOAN ASSOCIATION and
recorded in the aforesaid County in Mortgage 316, Page 715 on
April 21, 1986. Leader Federal Savings and Loan Association is
now known as Union Planters Bank, N.A. Said Mortgage and
Assignment are incorporated herein by reference.
5. The land subject to the Mortgage is: 282 ST. JOHNS
DRIVE, CAMP HILL, PENNSYLVANIA 17011 and is more particularly
described in Exhibit "Bu attached hereto.
6. The said Defendants are the real owners of the land
subject to the Mortgage.
7. The Mortgage is in default due to the fact that
Mortgagors have failed to pay the installment due on December 1,
1998 and all subsequent installments thereon, and the following
amounts are due on the Mortgage:
(a) Unpaid principal balance $ 72,605.19
(b) Interest at $24.20 per day
from 11/1/98 to 9/1/99
(based on contract rate of 12.000%) 6,630.80
(c) Accumulated Late Charges 377.52
(d) Late charges at $47.83
per month for 10 months 478.30
(e) Escrow Deficit 0.00
(f) 5% Attorney's Commission 3,630.26
$ 83,722.07
*Together with interest at the per diem rate noted in (b) above
after September 1, 1999 and other charges and costs to date of
Sheriff's Sale.
The attorney's fees set forth above are in conformity with
the Mortgage documents and Pennsylvania law, and will be
collected in the event of a third party purchaser at Sheriff's
Sale. If the Mortgage is reinstated prior to the sale,
reasonable attorney's fees will be charged that are actually
incurred by Plaintiff.
8. No judgment has been entered upon said Mortgage in any
jurisdiction.
9. Notice of intention to foreclose and accelerate the
loan balance pursuant to Pennsylvania Act No. 6 of 1974 is not
required in that the original principal balance exceeds
$50,000.00.
10. Defendants are not members of the Armed Forces of the
United States of America, nor engaged in any way which would
bring them within the soldiers and Sailors Relief Act of 1940, as
amended.
11. Plaintiff has complied with the procedures required by
Pennsylvania Act 91 of 1983 (Homeowners' Emergency Mortgage
Assistance Payments Program) and Defendants have either failed to
meet the time limitations as set forth therein or have been
determined by the Housing Finance Agency not to qualify for
assistance.
WHEREFORE, Plaintiff demands judgment in Mortgage
foreclosure "IN REM" for the aforementioned total amount due
together with interest at the rate of 12.0006 ($24.20 per diem),
together with other charges and costs including escrow advances
incidental thereto to the date of Sheriff's Sale and for
foreclosure and sale of the property within described.

hereinafter designated ss the Payee, the principal sum of NINETY-THREE THOUSAND
Dollars ($97,000.00)
with interest from date at the rate of TWELVE per centers ( 12 7.) per annum on the
unpaid balance until paid. The said principal and interest shall be payable at the office of the Payee

NINE HUNDRED PIFff each place as the holder may designate in

part thereof not lea than the amount of one installment, or One Hundred Dollars ($100.00), whichever is
less. Prepayment in fug shall be credited on the date received. Partial prepayment, other than on An
installment due date, need not be credited until the next following Installment due date or thirty days after
such prepayment, whichever h earlier.
Simultaneously with the execution of this Note the Maker has executed and delivered to the Payee
a Mortgage Secured upon certain prmnises shunted In the County of Cumberland
Commonwealth of Pennsylvania. more particularly described in the Mortgage. All of the terms, cove
nants, provisions, conditions, stipulations and nareenlents contained in said Mortgage to be kept and
performed by the Maker are hereby made a part of thin Note to the same extent and with the same
force and effect as if they were fully set forth horein, and the Maker covenants and agrees to perform
the name, or cause the same to be kept and performed, strictly in accordance with the terms and pro-
visions thereof.
The whole of the principal sum or any part thereof, and of any other sumo of money secured by
the Mortgage given to Astute this Note, shall. forthwith, at the option of the Payee or any subsequent
holder thereof, become due and payable immediately, without notice or demand, if default be made in
any payment under this Note, and it the default. In not made good prior to the due date or the next
such Installment; or upon the happening of any default which, by the terms of the Mortgage given to
secure this Note, shall entitle the Payee, or any subsequent holder berenf, to declare the same, or any
part thereof, to be due and payable.
The Maker does hereby empower any attorney of any court of record within the United Slates
