SECTION 65407 Comes now, Gary A. Johnston, Chairman of the Board of Supervisors and an individual elector of the Township of South Newton, Cumberland County, Pennsylvania, by and through counsel, Sally J. Winder, Solicitor to the Board of Supervisors of South Newton Township, and does petition the Court as follows: 1. South Newton Township, Cumberland County, Pennsylvania is a duly constituted Township of the Second Class. 2. As a Second Class Township, the procedure for appointment of Supervisors to the governing Board of Supervisors is established by 53 P. S. Section 65101, et rA., "The Second Class Township Code." 3. Section 407 of the Second Class Township Code, 53 P. S. Section 65407 provides that if two or more vacancies occur on a three-member board then the Court of Common Pleas shall fill the vacancies upon presentation of a petition signed by not less than fifteen electors of the township. 4. On August 24, 1999, Supervisor Thomas Bixler, Jr. resigned during a Special Meeting of the Board of Supervisors being conducted at the Township Building. 5. After the meeting of August 24, 1999, Supervisor Ronald B. Smith tendered a letter of resignation effective August 24, 1999. 6. Therefore, as of August 25, 1999, South Newton Township Board of Supervisors has two vacancies, the third Supervisor, Chairman of the Board, Gary A. Johnston remains in office. 7. The requisite number of electors of the Township have signed Petitions for Appointment of successor Supervisors requesting that the Court of Common Pleas appoint Thomas Bixler, Jr. and David Durff as Supervisors to fill the vacancies which have occurred on the Board of Supervisors of South Newton Township. The Petitions are attached hereto and made a part of this Petition by reference thereto. WHEREFORE, the Petitioners request this Honorable Court appoint Thomas Bixler, Jr. and David Durff as Supervisors of South Newton Township to fill the vacancies which have occurred on said Board to serve in such capacity pursuant to the provisions of The Second Class Township Code, 53 P.S. Section 65407.
