Stipulation Against Liens
THISAGREEMENT made the 1-?/ day of August .19 99
by and between Musser Hume Builders, Inc., of 10 Locust Grove Road, Dillaburg, PA 17019
hereinafter referred to as Contractor,
AND
Harold J. Sexton and Katherine R. Sexton, husband and wife, of West Windsor, NJ 08550
hereinafter, referred to as
Owner, whereby thejormerundertook and agreed to erect and construct a residential dwelling
on that certain lot of ground situate in
Cooke Township, Cumberland County, Pennsylvania containing 109,512 square feet,
2.51 acres and being all of lot no. 4 as shown on the Final Subdivision Plan of
Michaux Oaks prepared by Walter N. Hine Associates, Inc. dated November 12, 1991,
as revised December 18, 1991 and January 6, 1992 and recorded in the Office of
the Recorder of Deeds of Cumberland County in Plan Book 64, Page 46.
AND being the same premises which Michaux Oaks, a Pennsylvania Partnership, by its
deed dated November 25, 1998 and recorded in the Office of the Recorder of Deeds
in and for Cumberland County in Deed Book 190, Page 571, granted and conveyed unto
Harold J. Sexton and Katherine R. Sexton.
NOW THEREFORE, THIS AGREEMENT WITNESSETII: That the said Contractor, for and inconsideration of
the sum of (81.00) Dollar to i t in hand paid by Owner, the receipt whereof is hereby
acknowledged, and the further consideration mentioned in the agreement aforesaid, for themselves and their
subcontractors, and all parties acting through or under them, covenant and agree that no mechanic's liens or claims
shall be filed or maintained by them or any of them against the said buildings and the lot of ground appurtenant
thereto for or on account of any work done or materials furnished by them or any of them under said contract or
otherwise, for, towards, in, or about the erection and construction of the said buildings an the lot above described,
and the said Contractor, for themselves, their subcontractors and others under them hereby expressly waive and
relinquish the right to have, file, and maintain any mechanic's liens or claims against the said buildings or any of
them, and agree that this instrument, waiving the right of lien, shall be an independent covenant.
