COMPLAINT
AND NOW, comes Keystone Financial Bank, N.A., through its Attorney, William A.
Duncan, Esquire, and files this Complaint in Mortgage Foreclosure, of which the following is a
statement:
1. Plaintiff is Keystone Financial Bank, N.A., a corporation organized and existing
under the laws of the Commonwealth of Pennsylvania with its main office and principal place
of business located at I West High Street, Carlisle, Cumberland County, Pennsylvania 17013.
2. Defendant, DAVID D. LAUVER, an adult individual, resides at 207 Frystown
Road, Carlisle, Cumberland County, Pennsylvania, and Defendant, BARBARA A.
MCCLINTOCK, an adult individual, resides at 89 East Main Street, Newville, Cumberland
County, Pennsylvania.
3. On or about November 15, 1989, Defendant made, executed and delivered to
Plaintiff a real estate mortgage financing Sixty-one Thousand Six Hundred Sixty-two and
60/100 Dollars ($61,662.60), a copy of said real estate mortgage being attached hereto as
Exhibits "A" and incorporated herein by reference as though fully set forth.
4. On or about November 15, 1990, Defendants made, executed and delivered to
Plaintiff a note and security agreement financing Twenty-four Thousand Twenty-six and
38/100 Dollars ($24,026.38), a copy of said real estate mortgage being attached hereto as
Exhibit "B", respectively, and incorporated herein by reference as though fully set forth.
5. Said note and said real estate mortgage have not been assigned.
6. David D. Lauver, is the sole record owner in fee simple of said premises subject to
said mortgage, by virtue of a Deed dated November 14, 1989, and recorded in the Cumberland
County Recorder's Office in Deed Book Volume&PageNnmore specifically set forth in
Exhibit "C", attached hereto and made a part hereof by reference.
7. Said note and said real estate mortgage are in default because Defendants herein
have failed to pay the payments that were due and owing for the months of May 1999, June
1999, July 1999, and August 1999.
8. The Plaintiff has given to the Defendants written notice of intention to foreclose on
said mortgage as required by law under Act 6, dated July 20, 1999, a copy of which is marked
Exhibits "D" and "E", and attached hereto and made a part hereof by reference.
9. The Plaintiff has given written notice of default as required by the Homeowner's
Emergency Assistance Act of 1983, dated July 20, 1999, a copy of which is marked Exhibits
"P" and "G", and attached hereto and made a part hereof by reference.
10. By reason of the aforesaid default, the entire principal balance of Eighteen
Thousand One Hundred Twenty-one and 78/100 ($18,121.78) Dollars, with interest thereon at
the rate of 14.50 % percent per annum computed from May 5,. 1999, along with late charges
and attorneys fees now due and payable.

A. Principal amount and interest
due to date $16,625.71
B. Insurance credit - 166.50
C. Attorney's Collection fee 1,662.57
TOTAL: $ 18,121.78
WHEREFORE, Plaintiff prays the Court to enter judgment in favor of Plaintiff and
to order the foreclosure and sale of the mortgaged property and for the amount of Eighteen
Thousand One Hundred Twenty-one and 78/100 ($18,121.78) Dollars, together with interest
thereon, costs and all other amounts advanced by Plaintiff.

AND NOW, comes Keystone Financial Bank, N.A., through its Attorney, William A.
Duncan, Esquire, and files this Complaint in Mortgage Foreclosure, of which the following is a
statement:
1. Plaintiff is Keystone Financial Bank, N.A., a corporation organized and existing
under the laws of the Commonwealth of Pennsylvania with its main office and principal place
of business located at 1 West High Street, Carlisle, Cumberland County, Pennsylvania 17013.
2. Defendant, DAVID D. LAUVER, an adult individual, resides at 207 Frystown
Road, Carlisle, Cumberland County, Pennsylvania, and Defendant, BARBARA A.
MCCLINTOCK, an adult individual, resides at 89 East Main Street, Newville, Cumberland
County, Pennsylvania.
3. On or about November 15, 1989, Defendant made, executed and delivered to
Plaintiffa real estate mortgage financing Sixty-one Thousand Six Hundred Sixty-two and
60/100 Dollars ($61,662.60), a copy of said real estate mortgage being attached hereto as
Exhibits "A" and incorporated herein by reference as though fully set forth.
4. On or about November 15, 1990, Defendants made, executed and delivered to
Plaintiff a note and security agreement financing Twenty-four Thousand Twenty-six and
38/100 Dollars ($24,026.38), a copy of said real estate mortgage being attached hereto as
Exhibit "B", respectively, and incorporated herein by reference as though fully set forth.
5. Said note and said real estate mortgage have not been assigned.
6. David D. Lauver, is the sole record owner in fee simple of said premises subject to
said mortgage, by virtue of a Deed dated November 14, 1989, and recorded in the Cumberland
County Recorders Office in Deed Book 3?', Volume Pag?,y?nore specifically set forth in
Exhibit "C", attached hereto and made a part hereof by reference.
7. Said note and said real estate mortgage are in default because Defendants herein
have failed to pay the payments that were due and owing for the months of May 1999, June
1999, July 1999, and August 1999.
8. The Plaintiff has given to the Defendants written notice of intention to foreclose on
said mortgage as required by law under Act 6, dated July 20, 1999, a copy of which is marked
Exhibits "D" and "E", and attached hereto and made a part hereof by reference.
9. The Plaintiff has given written notice of default as required by the Homeowners
Emergency Assistance Act of 1983, dated July 20, 1999, a copy of which is marked Exhibits
"F" and "G", and attached hereto and made a part hereof by reference.
10. By reason of the aforesaid default, the entire principal balance of Eighteen
Thousand One Hundred Twenty-one and 78/100 ($18,121.78) Dollars, with interest thereon at
the rate of 14.50 % percent per annum computed from May 5,. 1999, along with late charges
and attorneys fees now due and payable.
11. The Defendants are liable to the Plaintiff for the following on said mortgage loan:
A. Principal amount and interest
due to date $16,625.71
B. Insurance credit - 166.50
C. Attorney's Collection fee 1,662.57
TOTAL: $18,121.78
WHEREFORE, Plaintiff prays the Court to enter judgment in favor of Plaintiff and
to order the foreclosure and sale of the mortgaged property and for the amount of Eighteen
Thousand One Hundred Twenty-one and 78/100 ($18,121.78) Dollars, together with interest
thereon, costs and all other amounts advanced by Plaintiff.

The MORTGAGE held by Keystone Financial Bank, N.A., (hereinafter we, us or ours) on your
property located at 207 Frystown Rd., Carlisle, PA 17013 IS IN SERIOUS DEFAULT because you
have not made the following monthly payments: $328.08 for May 15, 1999; $328.08 for June 15, 1999;
and $328.08 for July 15, 1999.
Late charges (and other charges) have also accrued to this date in the amount of $0. The total
amount now required to cure this default, or in other words, get caught up in your payments, as of the
date of this letter, is $984.24.
You may cure this default within THIRTY (30) DAYS of the date of this letter, by paying to us the
above amount of $984.14, plus any additional monthly payments and late charges which may fall due
during this period. Such payment must be either by cash, cashier's check, certified check or money
order, and made at Keystone Financial Bank, N.A., P.O. Box 1384, Pottsville, PA 17901-1384.
If you do not cure the default within THIRTY (30) DAYS, we intend to exercise our right to
accelerate the mortgage payments. This means that whatever is owing on the original amount borrowed
will be considered due immediately and you may lose the chance to pay off the original mortgage in

mortgage is foreclosed, your mortgaged property will be sold by the Sheriff to pay off the mortgage debt.

The MORTGAGE held by Keystone Financial Bank, N.A., (hereinafter we, us or ours) on your
property located at 207 Frystown Rd., Carlisle, PA 17013 IS IN SERIOUS DEFAULT because you
have not made the following monthly payments: $328.08 for May 15, 1999; $328.08 for June 15, 1999;
and $328.08 for July 15, 1999.
Late charges (and other charges) have also accrued to this date in the amount of $0. The total
amount now required to cure this default, or in other words, get caught up in your payments, as of the
date of this letter, is $984.24.
You may cure this default within THIRTY (30) DAYS of the date of this letter, by paying to us the
above amount of $984.24, plus any additional monthly payments and late charges which may fall due
during this period. Such payment must be either by cash, cashier's check, certified check or money
order, and made at Keystone Financial Bank, N.A., P.O. Box 1384, Pottsville, PA 17901-1384.
If you do not cure the default within T=TY (30) DAYS, we intend to exercise our right to
accelerate the mortgage payments. This means that whatever is owing on the original amount borrowed
will be considered due immediately and you may lose the chance to pay off the original mortgage in
monthly installments. If full payment of the amount of default is not made within THIRTY (30) DAYS,
we also intend to instruct our attorneys to start a lawsuit to foreclose your mortgaged property. If the
mortgage is foreclosed, your mortgaged property will be sold by the Sheriff to pay ofjthe mortgage debt.

against you, you will still have to pay the reasonable attorney's fees, actually incurred, up to $50.00.
However, if legal proceedings are started against you, you will have to pay the reasonable attorney's fees
even if they are over $50.00. Any attorneys fees will be added to whatever you owe to us, which may
also include our reasonable costs. If you cure the default within the thirty day period, you will not be
required to pay attorney's fees.
We may also sue you personally for the unpaid principal balance and all other sums due under the
mortgage.

If you have not cured the default within the thirty day period and foreclosure proceedings have
begun, you still have the right to cure the default and prevent the sale at any time up to one hour before
the Sheriffi foreclosure sale. You may do so by paying the total amount of the unpaid monthly payments
plus any late or other charges then due, as well as the reasonable attorney's fees and costs connected
