ESH, t/d/b/a ESH'S CONSTRUCTION, Contractor 99- 5480 MLD TERM Whereas, RgWW L. Spahr and Penny S. Spahr, his wife, of Cumberland County, Pennsylvania are about to execute contemporaneously herewith, a contract with Michael A. Esh, t/d/b/a Esh's Construction, of Cumberland County, Pennsylvania, for the erection of a dwelling house upon a lot of land situate in West Pennsborough Township, Cumberland County, Pennsylvania, being known as Lot No. 16, Pennsborough Farms, as recorded in Cumberland County Plan Book 55, Page 26. Legal Description: BEGINNING at an iron pin in the centerline of Kerns Road (T442) and comer of Lot No. 15 on the above referenced Plan; thence within said road, South 34 degrees 21 minutes 10 seconds East, 63.59 feet to a point; thence along, within and through same and along lands now or formerly of Eva L. and Elizabeth Evelhock, South 44 degrees 52 minutes 33 seconds West, 98.63 feet to a point at lands now or formerly of Eva L. and Elizabeth Evelhock; thence along lands now or formerly of Eva L. and Elizabeth Evelhock, South 69 degrees 26 minutes 33 seconds West, 781.45 feet to an iron pin; thence along lands now or formerly of R. Robert and Nancy Goodyear Baisch, North 40 degrees 34 minutes 40 seconds West, 263.31 feet to an iron pin at the comer of Lot No. 12 on the above referenced plan; thence along Lot No. 12, North 54 degrees 41 minutes 12 seconds East, 442.84 feet to an iron pin at the comer of Lot No. 14; thence along Lot No. 14 of above referenced plan, South 35 degrees 00 minutes 42 seconds East, 144.97 feet to an iron pin at the comer of Lot No. 14 and Lot No. 15 of the said plan; thence along said Lot No. 15, South 34 degrees 21 minutes 10 seconds East, 150.00 feet to an iron pin at the comer of Lot No. 15; thence along said Lot No. 15, North 55 degrees 38 minutes 50 seconds East, 325.00 feet to an iron pin and the point and place of BEGINNING. Now, September 8, 1999, at the time of and immediately before the execution of the principal contract, and before any authority has been given by the said Owners to the said Contractor to commence work on the said building, or purchase materials for the same, in consideration of the making of the said contract with them and the further consideration of one Dollar, to Contractor paid by CAvners, it is agreed that no lien shall be filed against the building by the contractor, or any sub-contractor, nor by any of the material men or workmen or any other person for any labor, or materials purchased, or extra labor or materials purchased for the erection of said building, the right to file such liens being expressly waived.
