IN OPPOSITION TO PLAINTIFF'S MOTION TO FILE AMENDED COMPLAL
I. STATEMENT OF FACTS.
The present matter arises out of a "puff back" which occurred on March 3, 1998 at the
Plaintiffs premises. Defendant, Keystone Oil, visited the premises on July 25, 1997 and seemingly
replaced the nozzle on Plaintiffs heating unit on that occasion.
Plaintiffs filed their Complaint on or about September 9, 1999. Plaintiff's Complaint sought
damages for breach of contract and negligence. Plaintiff now seeks permission to amend its
Complaint to pursue a cause of action based on strict liability and breach of warranty. Since both
claims are barred by the Statute of Limitations, this amendment should not be permitted.
II. LEGAL ARGUMENT
1. Whether amendments seeking to add new causes of action should be permitted after the
running of the Statute of Limitations?
Our courts have a well-established principle forbidding an amendment to introduce a new
cause of action that is barred by the Statute of Limitations. Kramer v. State Farm Fire & Cas. Ins.
Co., (1992), 412 Super. Ct. 227, 603 A. 2d 192; also see Standard Pennsylvania Practice Second,
Section 2440.
An amendment to a Complaint is not permissible after the expiration of the statutory period
when the purpose is to introduce a new cause of action. Bendes v. White Deer, (1990), 131
Cmwlth. Ct. 138, 569 A.2d 1000.

A new cause of action is introduced where the amendment offers a different theory or basis
for recovery. Krauss v. Great Lakes Holdings. Inc., (1989), 387 Super. Ct. 56, 563 A.2d 1182.
In the present matter, a new theory or basis for recovery is sought, Plaintiff now seeks to
amend her Complaint adding a count for strict liability based upon an allegedly defective product
being provided. Similarly, Plaintiff seeks to add a breach of warranty claim again offering a
different theory of recovery. Such amendments should not be permitted after the Statute of
Limitations has run.
In D'Attilio v. Hershey Estates (1966), 39 D&C 2d 759, plaintiff sought to amend its
Complaint to add an allegation that an amusement park ride was inherently dangerous for use by
children to existing claims that the ride was negligently operated at an excessive speed and without
protective devices. The Court, in denying Plaintiff permission to amend, determined that
amendments of a Plaintiffs theory or the kind of negligence sued on were inappropriate after the
running of the Statute of Limitations.
Similarly in the present matter, the Plaintiff should not be permitted to add new causes of
action after the running of the Statute of Limitations.
2. Whether the amendments sought by the Plaintiff are barred by the Statute of Limitations?
The Statute of Limitations on Plaintiffs proposed strict liability claim is two years. See 42
Pa.C.S.A. Section 5224. In the present matter, Plaintiffs cause of action accrued on March 3,
1998. The present amendment is subsequent to this two year statute of limitations.
Plaintiffs breach of warranty claim is governed by a four year statute of limitations which
runs after the cause of action has accrued. A cause of action for breach of warranty occurs when
tender of delivery is made. Furthermore, this is true regardless of the aggrieved parry's lack of
knowledge of the breach. See 13 Pa.C.S.A. Section 2725(a) and (b).
In City of Philadelphia v Lead Industries Association Inc., C.A. 3 (PA) (1993), 944 F. 2d
112, it was held that a breach of warranty claim against a manufacturer of lead pigment used in paint
accrued under Pennsylvania law when delivery of paint was tendered. Furthermore, the Court held
that the discovery rule did not apply to breach of warranty claims.
Similarly in the present matter, the Plaintiff s cause of action for breach of warranty accrued
as of the date the allegedly defective nozzle was provided, which seemingly was July 25, 1997. In
excess of four years have passed since this nozzle was provided.
III. CONCLUSION
Since the Plaintiff seeks to add new causes of action which are barred by the Statute of
Limitations, the present amendment should not be permitted.

MOTION TO FILE AMENDED COMPLAINT
NOW COMES PLAINTIFF May Lewis, by her counsel, Jesse Raymond Ruhl,
and files the within Motion to Amend Complaint pursuant to Pa.R.Civ.P. 1033 as follows:
I. On or about September 9, 1999, Plaintiff filed her Complaint against Defendant.
2. Plaintiffs Complaint contained two counts, a claim of negligence and a claim for breach
of contract.
3. In the course of discovery, Plaintiff uncovered evidence that would support additional
causes of action against Defendant, namely a claim for strict liability and a claim for
breach of warranty.
4. Plaintiffs proposed Amended Complaint is attached hereto at Exhibit "A" and is
incorporated herein by reference.
5. Pennsylvania Rule of Civil Procedure 1033 provides that a party "either by filed consent
of the adverse party or by leave of court, may at any time change the form of action,
correct the name of the party or amend his pleading...: '
6. Defendant's counsel has failed to grant his consent to Plaintiff filing her Amended
Complaint.
WHEREFORE Plaintiff Mary Lewis respectfully requests that the Court enter an Order
granting Plaintiff leave to file her Amended Complaint as set forth hereto at Exhibit "A" within
twenty (20) days.

NOW COMES PLAINTIFF May Lewis, by her counsel, Jesse Raymond Ruhl,
and files the within Complaint as follows:
1. Plaintiff is an adult individual currently residing at 2804 Market Street, Camp
Hill, PA 17011.
2. Defendant, upon information and belief, is a corporation organized and existing
pursuant to the laws of the Commonwealth of Pennsylvania with a principal place of business
located at 1600 Hummel Avenue, Camp Hill, PA 17011.

3. Defendant provided the service to Plaintiffs furnace, and on July 25, 1997,
Defendant serviced Plaintiffs furnace and installed a new furnace nozzle at the time of the
service.
4. On March 3, 1998, the furnace in the Plaintiff s real property malfunctioned and
caused Plaintiffs real property to become flooded with smoke and soot, this occurrence
otherwise known as a "puff back" malfunction.
5. The "puff back" malfunction occurred and resulted because the Defendant failed
to maintain properly Plaintiffs furnace, including the failure to have the furnace properly cleaned
on July 25, 1997 and/or to install properly the nozzle to the furnace on July 25, 1997.
6. As a result of the smoke and soot which flooded Plaintiff's real property, Plaintiff
suffered damage in the amount of $15,885.46, calculated as follows:
a: Structure cleaning and painting: $11,669.00
b. Dry-cleaning: $1,621.57
C. Carpet cleaning: $2,594.89
TOTAL DAMAGES: $15,885.46
Documentation exhibiting the damages suffered by Plaintiff are attached hereto as Exhibit "A"
and incorporated herein by reference.

7. Despite demand therefore, Defendant has failed and/or refused to pay for
Plaintiff's loss and damage.
COUNT I - BREACH OF CONTRACT
8. The foregoing averments are incorporated herein by reference.
9. As described above, the failure to provide Plaintiff with a safe-operating and
hazard-free furnace was a breach of the service agreement/contract between Plaintiff and
Defendant.
10. Plaintiff has suffered damage in the amount of $15,885.46 as a result of the
Defendant's breach.
11. Defendant's breach is the proximate cause of the Plaintiffs loss, and Plaintiff has
at all times performed her obligations to Defendant by paying for Defendant's services.
WHEREFORE PLAINTIFF demands judgment in her favor and against Defendant in the
amount of $15,885.46, plus interest, costs of suit and attorneys fees.
COUNT II - NEGLIGENCE
12. The foregoing averments are incorporated herein by reference.

13. As described above, the failure to provide Plaintiff with a safe-operating and
hazard-free furnace was a breach of the duty owed by Defendant to Plaintiff.
14. Plaintiff has suffered damage in the amount of $15,885.46 as a result of the
Defendant's breach of duty.
15. Defendant's breach is the proximate cause of the Plaintiffs loss, and Plaintiff has
at all times performed her obligations to Defendant by paying for Defendant's services.
16. Defendant negligently and carelessly breached its duty to Plaintiff by failing to
maintain Plaintiff s furnace and the furnace nozzle in a proper working order and by failing to
have the furnace and the furnace nozzle routinely and properly cleaned and maintained.
COUNT III - BREACH OF WARRANTY
17. The foregoing averments are incorporated herein by reference.
18. Defendant held itself out to Plaintiff as having expertise and experience in the fuel
oil and furnace maintenance business.
19. Defendant made express written and oral warranties to the Plaintiff with regard to
the service and maintenance of the furnace and the furnace nozzle.

20. In particular, Defendant advised Plaintiff that Plaintiffs furnace and furnace
nozzle were properly functioning and serviced as part of the service agreement maintained
between Plaintiff and Defendant.
21. As described above, the failure to provide Plaintiff with a safe-operating and
hazard-free furnace was a breach of the express and implied warranties provided to Plaintiff by
Defendant.
22. Plaintiff has suffered damage in the amount of $15,885.46 as a result of the
Defendant's breach of warranties to Plaintiff.
23. Defendant's breach of warranties is the proximate cause of the Plaintiffs loss, and
Plaintiff has at all times performed her obligations to Defendant by paying for Defendant's
services.
WHEREFORE PLAINTIFF demands judgment in her favor and against Defendant in the
amount of $15,885.46, plus interest, costs of suit and attorneys fees.
COUNT IV - STRICT LIABILITY
24. The foregoing averments are incorporated herein by reference.
25. Defendant sold the furnace nozzle to Plaintiff. As a seller, Defendant is strictly
liable for any and all damages which may have resulted from the use of the defective furnace
nozzle.
26. Defendant sold Plaintiff a furnace nozzle which was defective and dangerous.
27. As a direct and proximate result of the use of said defective furnace nozzle,
Plaintiff suffered damages in $15,885.46.
WHEREFORE PLAINTIFF demands judgment in her favor and against
Defendant in the amount of $15,885.46, plus interest, costs of suit and attorneys fees.

MOTION TO COMPEL DISCOVERY
Defendant Keystone Oil Products, Corp., by its undersigned attorney, hereby moves the
Court to enter an Order pursuant to Pa. R.C.P. 4019 compelling Plaintiff to answer and/or produce
certain discovery matter the requests for which were propounded upon Plaintiff by the Defendant.
In support of its Motion, the Defendant avers as follows:
1. The instant civil action, involving claims of negligence and breach of contract, was
commenced by the filing of a complaint on or about September 9, 1999.
2. An answer with New Matter was filed by the Defendant on October 18, 1999.
3. On or about December 4, 1999, Defendant served upon Plaintiff's counsel its First
Set of Written Interrogatories and Request for Production of Documents and Things. A true and
correct copy of the transmittal letter accompanying these materials is attached hereto as Exhibit "A."
4. Pursuant to Pa. R.C.P. 4006(a)(2), Plaintiff's answers and objections, if any, to any
of the aforementioned discovery was originally due on or before January 3, 2000.
6. To date, Plaintiff has failed to produce any of the aforesaid discovery matter.
7. Defendant's counsel has, in good faith, attempted to consult with Plaintiff s counsel
in order to resolve this matter but has been unsuccessful. Attached hereto as Exhibits "B" and "C"
are true and correct copies of letters sent to Plaintiffs counsel seeking Defendant's compliance with
the Rules of Discovery.
8. The information requested by Defendant is pertinent to the defense of this matter
which will be greatly prejudiced by Plaintiffs continued failure to fully and completely respond.
9. Defendant therefore requires an Order from this Court pursuant to Pa. R.C.P.

paragraph. Strict proof, if relevant, is demanded at trial. With regard to the averment that on July
25, 1997, defendant performed service upon plaintiffs furnace and installed a new nozzle, this
allegation is admitted. '

any obligation that it had with reference to the plaintiffs furnace. More specifically, it is
specifically denied that the answering defendant failed to properly clean the furnace on July 25,
1997 and/or to properly install the relevant nozzle on that date. Certain averments contained in this
paragraph are conclusions of law to which no response is required. By way of further response,
allegations regarding the occurrence of a "puff-back" are denied, as after reasonable investigation u

9. Denied. Certain averments contained in paragraph 9 are conclusions of law to which
no response is required. By way of further response, it is specifically denied that the answering
defendant breached any service agreement and/or contract with plaintiff. Answering defendant is
uncertain as to what plaintiff means by "safe operating and hazard-free furnace." To the extent
answering defendant understands these terms and its obligations regarding the same, it is specifically
denied that answering defendant failed to provided plaintiff with the same.

answering defendant breached any service agreement and/or contract with plaintiff. Certain
averments contained in this paragraph are conclusions of law to which no response is required. By
way of further response, answering defendant is uncertain as to what plaintiff means by "safe

that any action and/or inaction on the part of the answering defendant constituted a breach of duty.
By way of further response, it is specifically denied that the answering defendant failed to maintain
plaintiffs furnace in accordance with its duties under the law. It is specifically denied that
answering defendant failed to install a furnace nozzle in a proper fashion.
WHEREFORE, answering defendant respectfully requests this Honorable Court to enter
judgment in their favor.
NEW MATTER
17. Answering Defendant incorporates herein by reference as though fully set forth at
length the averments of its Answer with New Matter.
18. Defendant had no duty to go beyond its contractual obligations.
19. Answering Defendant breached no contract.
20. Any damages allegedly sustained were due to the actions and/or inactions of entities
over whom Answering Defendant has no control.
21. All claims against Answering Defendant are barred by the statute of limitations.
22. Claims against the Answering Defendant are barred by Lamp v. Heyman and its
progeny.

3. Denied, as stated. Answering Defendant does not believe that any claim for strict
liability and/or breach of warranty against it exists.
4. Denied, as stated. It is admitted that Plaintiff's proposed Amended Complaint is
attached as Exhibit "A".
5. Denied, as stated. It is admitted that a portion of Pennsylvania Rule of Civil Procedure
1033 is quoted. However, this is only part of the relevant rule. Additionally, our Courts have held
that amendments which seek to add new causes of action after the Statute of Limitations has run are
generally inappropriate.

WHEREFORE, Defendants respectfully request this Honorable Court enter an Order denying
Plaintiff's Motion.
NEW MATTER
7. The present matter arises out of an incident which occurred on or about March 3, 1998

10. Plaintiff's claim to add a count for breach of warranty is similarly untimely.
11. Breach of warranty claims require timely notice.
12. Plaintiff provided no such timely notice of any alleged breach of warranty.
13. Pursuant to Section 2-725 of the Uniform Commercial Code, 13 Pa.C.S.A. Section
2725, "a cause of action accrues when the breach occurs, regardless of the aggrieved party's lack of
knowledge of the breach. A breach of warranty occurs when the tender of delivery is made..."
14. In excess of four years have passed since the date upon which the tender of delivery
of the relevant nozzle was made.
15. The Plaintiffs claim for breach of warranty is barred by the Statute of Limitations.
WHEREFORE, Answering Defendant respectfully request that this Honorable Court enter an
Order denying Plaintiffs Motion.
