SHIELDS, Defendant : Action in Mortgage Foreclosure COLAINT IN MORTGAGE FORECLOSURE 1. Plaintiff Commerce Bank/Harrisburg, N.A. ("Commerce"), is a national banking association whose principal place of business is located at 100 Senate Avenue, Camp Hill, Pennsylvania 17011. 2. Defendant William D. Shields is an adult individual residing at 668 State Street, Lemoyne, Pennsylvania 17043. 3. On or about April 29, 1997, the Defendant executed and delivered to Commerce a Promissory Note evidencing his obligation to Commerce under a loan in the principal amount of $10,000.00 together with interest thereon and other charges as more particularly provided in the Promissory Note. A true and correct copy of the Promissory Note is attached hereto as Exhibit "A" and made a part hereof (the "Note"). 4. Commerce advanced the full amount of $10,000.00 to the Defendant under the Note. 5. The indebtedness owed by the Defendant to Commerce under the Note is in payment default. The Defendant failed to make the payments of all principal, interest and other charges due on the Note on May 3, 1999, June 3, 1999, July 3, 1999, and August 3, 1999. Such defaults are continuing. 6. Payment of the indebtedness owed by the Defendant to Commerce under the Note is secured by a first mortgage lien against the real property located at 668 State Street, Lemoyne, Pennsylvania 17043 and described in that certain Mortgage dated April 29, 1997 executed by the Defendant in favor of Commerce and recorded in the Cumberland County Recorder of Deeds Office in Record Book 1381, Pages 300, et M. A true and correct copy of such Mortgage is attached hereto as Exhibit "B" and made a part hereof. 7. Commerce duly notified the Defendant of its intent to foreclose. A true and correct copy of such Notice is attached hereto as Exhibit "C" and made a part hereof. 8. Through August 30, 1999, the Defendant is indebted to Commerce under the Note in the amount of $6,794.11 plus attorneys' fees and other costs of collection. Such amount is computed as follows: Principal through August 30, 1999 $6,590.37 Interest through August 30, 1999 $193.74 Late fees through August 30, 1999 10.00 TOTAL $6,794.11 Interest continues to accrue on such indebtedness on a per diem basis at the rate of 7.250% Mr annum as provided in the Note in an amount equal to $1.31 r diem. -2- WHEREFORE, Plaintiff respectfully requests thatyour Honorable Court enter judgment in mortgage foreclosure in favor of Commerce and against the Defendant in the amount of $6,794.11 plus interest thereon of $1.31 per diem, at the interest rate provided in the Note, from August 30, 1999 plus attorneys' fees, costs and other charges as provided in the Note; directing foreclosure and sale of the mortgaged property; and awarding Commerce such other relief as is just under the circumstances.
