ORDER
AND NOW, this 210 day of 2000, upon receipt of the
Conciliator's Report, it appearing that the parties have agreed to the terms and provisions of this
Order which was dictated in their presence and approved by them and their counsel, it is hereby
ordered and directed as follows:
1. The Order of October 28,1999, is VACATED.
2. The Order of October 7, 1999, subparagraph 5, shall be modified as
follows:
5. Father shall be entitled to periods of partial custody with
the child on alternating weekends from Friday until Sunday, at
times to be agreed upon by the parties. This alternating weekend
schedule shall commence on Friday, January 7, 2000. Father
agrees that during the weekends of partial custody the child shall
sleep over at the paternal grandmother's residence, Vicki Jenkins,
or at another residence as the parties may agree upon.
Additionally, Father shall be entitled to periods of visitation one
time during the week on a date and time to be agreed upon by the
parties.

During the weekend periods of partial custody,
transportation can be effectuated by Vicki Jenkins, Michael Yohe,
or Beverly Yohe. During the mid-week visitation, Mother shall
provide the transportation to and from Vicki Jenkins' house unless
other arrangements are made between Mother and Vicki Jenkins.
Father agrees that during the periods of time that he is
exercising partial custody or visitation, that he shall not drink any
alcoholic beverages.
3. In all other respects, the Order of October 7, 1999, shall remain in full
force and effect.
4. The parties shall reconvene for another custody conciliation
conference before Michael L. Bangs, Esquire, on Thursday, April 13, 2000, at
9:00 a.m.

1. The Plaintiff is Timothy L. Yohe, residing at 126
Spring Road, Dillsburg, York County, Pennsylvania 17019.
2. The Defendant is Christine Yohe, residing at 4709
Delbrook Road, Mechanicsburg, Cumberland County, Pennsylvania.
3. The Plaintiff seeks partial custody of the following

4. The relationship of Plaintiff to the child is
natural father. The Plaintiff currently resides with the

of natural mother. The Defendant currently resides with the

6. Plaintiff has not participated as a party or
witness, or in another capacity, in other litigation
concerning the custody of the child in this or another Court.
Plaintiff has no information of a custody proceeding
concerning the child pending in a Court of this commonwealth.
Plaintiff does not know of a person not a party to
these proceedings who has physical custody of the child or
claims to have custody or visitation rights with respect to
the child, except for the paternal grandmother who is seeking
rights of partial custody.
7. The best interest and permanent welfare of the child I .
will be served by granting the relief requested because the
Plaintiff has participated in the rearing of the child, can
better provide to the child a stable, safe, and secure

environment and can provide for the child's emotional,
psychological and spiritual needs. Further, the child views
the Plaintiff as a source of stability, a source of love, and
a source of emotional support.
8. Each parent whose parental rights to the child have
not been terminated and the person who has physical custody of
the child have been named as parties to this action. All
other persons, named below, who are known to have or claim a
right to custody or visitation of the child have been given
notice of the pendency of this action and the right to
intervene: Vicki S. Jenkins.
WHEREFORE, Plaintiff requests the Court to grant partial
custody of the child.

supervised visitation shall be supervised by the paternal
grandmother, Vicki Jenkins. Additionally, Father shall be entitled
to periods of supervised visitation one time during the week, on a
date and time to be agreed upon by the parties; this shall also be
supervised by Vicki Jenkins.
2. In all other respects, the Order of October 7, 1999, shall remain in full
force and effect.
3. The parties shall reconvene for another custody conciliation
conference before Michael L. Bangs, Esquire, on Thursday, December 16,
1999, at 3:00 p.m.
