KUTZ, his wife I IN THE COURT OF COMMON PLEAS Owner I CUMBERLAND COUNTY, PENNSYLVANIA I versus I I HOFFMAN'S CUSTOM I CONTRACTING, I Contractor I Whereas, George A. Kurz and Peggy A. Kurz, his wife of Carlisle, Cumberland County, Pennsylvania is about to execute contemporaneously herewith, a contract with Hoffman's Custom Contracting of 21 Annendale Drive, Carlisle, Cumberland County, Pennsylvania, for the erection of a house upon a lot of land situate in Dickinson Township, Cumberland County, Pennsylvania, being known as Lot No. 22, Subdivision Plan for Annendale, as recorded in Cumberland County Plan Book 73, Page 111, etc. BEGINNING at a point on the southern line of 50 feet wide Makenzee Drive at the dividing line between Lots No. 22 and 23; thence from said point at the Place of Beginning along said southern line of 50 feet wide Makenzee Drive by a curve to the left having a radius of 225 feet an arc distance of 136.63 feet to a point at the dividing line between Lots Nos. 21 and 22; thence along said dividing line between said Lots Nos. 21 and 22; South 03 degrees 50 minutes 35 seconds West a distance of 279.48 feet to a point in line of land now or formerly of D. William Green; thence along line of said land now or formerly of D. William Green, South 66 degrees 58 minutes 1 I seconds West a distance of 184.03 feet to a point in line of land now or formerly of Rockwell fame; thence along line of said land now or formerly of Rockwell Farms, North 30 degrees 07 minutes 30 seconds West a distance of 215.13 feet to a point at the dividing line between Lot Nos. 22 and 23; thence along said dividing line between said Lots Nos. 22 and 23, North 38 degrees 38 minutes l 1 seconds East a distance of 273.34 feet to a point on the Southern line of said 50 feet wide Makenzee Drive at the Place of BEGINNING. THE ABOVE-described lot of land is all of Lot No. 22 as shown on said Subdivision Plan for Annendale recorded as aforesaid, and contains an area of 76,001.26 square feet or 1.745 Acres, more or less. Now, August 12, 1999, at the time of and immediately before the execution of the principal contract, and before any authority has been given by the said Owners to the said Contractor to commence work or the said building, or purchase materials for the same in consideration of the making of the said contract with them and the further consideration of one Dollar, to Contractor paid by Owners it is agreed that no lien shall be filed against the building by the contractor, or any sub-contractor, nor by any of the material men or workmen or any other person for any labor, or materials purchased, or extra labor or materials purchased for the erection of said building, the right to file such liens being expressly waived.
