You have been sued in Court. If you wish to defend against the claims set forth in the
following pages, you must take action within (20) days after this complaint and noticc are
served, by entering a written appearance personally or by attorney and filing in writing with
the Court your defenses or objections to the claims set forth against you. You are warned that
if you fail to do so the case may proceed without you and a judgment may be entered against
you by the Court without further notice for any money claimed in the complaint or for any
other claim or relief requested by the Plaintiff. You may lose money or property or other
rights important to you.

COMPLAINT
Plaintiffs, Joseph F. Balascio and Irma W. Balascio, by their attorneys, Broujos & Gilroy,
P.C., set forth the following:

Plaintiffs, Joseph F. Balascio and Inna W. Balascio, are adult individuals residing at 734
Sherwood Drive, Carlisle, Cumberland County, Pennsylvania.

Plaintiffs are the owners of a certain tract of ground located at 421 Arch Street, Borough of
Carlisle, Cumberland County, Pennsylvania, more particularly set forth by deed into
Plaintiffs which was recorded in the Cumberland County Recorder of Deeds Office at Book
"M", Volume 35, Page 723 (said land hereinafter referred to as the "Balascio Property").

Defendants, Daniel J. Shay and Anastasia Pappas, are adult individuals residing at 419
Arch Street, Carlisle, Cumberland County, Pennsylvania and are the owners of said
property at 419 Arch Street by a deed recorded in the Cumberland County Recorder of
Deeds Office in Deed Book 214, Page 550 (hereinafter referred to as the "ShaylPappas
Property").

Plaintiffs employed the firm of Brehm-Lebo Engineering, Inc. to do a boundary survey of
the Balascio Property and of the ShaylPappas Property, said survey having been completed
and is attached hereto and marked Exhibit "A" (hereinafter referred to as the "Survey").
The Survey was initiated after Defendants constructed a fence along the borderline of the
Balascio Property and the ShaylPappas Property, which fence Plaintiffs believed to be
encroaching onto their property.

Additionally, Defendants constructed a fence at the rear of their property which continued
to the garage owned by the Plaintiffs and which interfered with Plaintiffs access to their
property on the northern side of their garage.

The Survey verifies that the fence mentioned in Paragraph 4 above encroaches from
between 0.37 feet to 1.21 feet on the Plaintiffs property.

The Survey also shows that approximately 1.21 feet ofthe Plaintiffs' property is located on
the northern side of Plaintiffs' garage in an area where Defendants have attempted to block
Plaintiffs' access and where Defendants have constrncted a fence at the rear of the
properties interfering with Plaintiffs' use and access to their land.

Plaintiffs have repeatedly demanded possession of their premises hy removal of the fence in
the middle of the property in order to be consistent with the accurate boundary line as
shown on the Survey and by removal of the fence at the rear of the property to be
consistent with the existing boundary line and to allow Plaintiffs access to the northern side
of their garage area. Despite these repeated demands, Defendants have refused to deliver
possession the said property.

Plaintiffs will incur expenses in the damage caused to their property as a result of
construction of the mentioned fence and the monetary damages that will be involved to
restore Plaintiffs property to its original grade including replacement and repair of the
lawn area.
WHEREFORE, Plaintiffs demand judgment against the Defendants as follows:
A. The court to award to Plaintiffs possession of their property in accordance
with the Survey.
B. The court to award damages for Plaintiffs repair oftheir property.
C. The Court to award costs of this prosecution.
D. Such other relief as the court deems appropriate.
