Plaintiff, Robert Burke, is an adult individual residing at 369 Futurity Drive, Fairview Township, York County, Pennsylvania. 2. Defendants, James F. Sibbersen and Janet L. Sibbersen, are adult individuals residing at 218 Green Lane Drive, Fairview Township, York County, Pennsylvania. 3. On or about September 23, 1997, at approximately 6:00 p.m., Plaintiff was jogging on Green Lane Drive in Fairview Township, York County, Pennsylvania. 4. While Plaintiff was jogging past the residence of the Defendants at 218 Green Lane Drive, he was struck by a Labrador Retriever dog which was under the care, control and possession of the Defendants. 5. The dog in question ran from the property of the Defendants between two parked cars and knocked the Plaintiff to the ground, causing him serious and permanent personal injuries. -3- 5092.1.8 6. Plaintiffs injuries and damages, as hereinafter set forth, were caused by the negligence of the Defendants in that they: a. Violated the Pennsylvania Dog Law, 3 P.S. §459-305, which makes it unlawful for the owner of a dog to fail to keep such dog at all times confined within the premises of the owner. b. Failed to keep their dog behind securely fastened and closed doors while in their house. C. Failed to keep their dog tethered outside or on a leash. d. Failed to be aware of the location of their dog at all times to monitor his location and make sure he did not leave the premises. e. Failed to lake any precautions, or took inadequate precautions, to make sure that their dog did not leave their premises and run into the public street. 7. As a result of Defendants' negligence, Plaintiff suffered serious and permanent injuries, including, but not limited to the following: a. A comminuted Colle's fracture of the left distal radius with slight dorsal angulation. b. Pain and shock to the injury site and left arm. C. Numbness along the left median nerve distribution. d. Chronic carpal tunnel syndrome left arm. e. Swelling and tenderness over the left carpal bones. f. Weakness of his left hand grip. -4- 5092-1.8 g. Malunion of the left distal radius with significant dorsal angulation and radial shortening. h. Traumatic scapholunate dissociation left wrist with early carpal collapse. 8. As a further result of Defendants' negligence, Plaintiff has suffered the following damages, some of which may be permanent in nature: a. Pain and suffering. b. Loss of life's pleasures. C.
