CONFESSED JILDQMENT COMPLAIN
Plaintiff files this Complaint pursuant to Pa. R.C.P. No. 2951(b) for Confession of Judgment and avers the
following:
1. Plaintiff is The Estate of Arthur F. Nelson, Jr., Deceased, by Arthur F. Nelson, III and Patricia
Carnathan, Co-Executors of said Estate.
2. Defendant, ANDREW V. FINE, is an adult individual who maintains an address at 432 Pawnee
Drive, Mechanicsburg, Cumberland County, Pennsylvania 17055.
3. Defendant, STELLA ANN FINE, is an adult individual who maintains an address at 432 Pawnee
Drive, Mechanicsburg, Cumberland County, Pennsylvania 17055.

4. On the 4th day of November, 1982, Defendants did sign a Judgment Note in the face amount of
$18,000.00, with interest thereon at the rate of 12%, per annum. A true and correct copy of said Judgment Note is
attached hereto, marked as Exhibit "A" and made a part hereof.
5. Despite the installments being set at $2,500.00 each, and the term of the Note being three (3) years,
Defendants have made only three (3) installment payments, each in the amount of Two Hundred Fifty ($250.00)
Dollars, for which credit has been given by Plaintiffs.
6. The attached instrument has not been assigned.
Judgment has not been entered on the attached instrument in any jurisdiction.
8. Under the Confession of Judgment clause contained in the aforesaid Note, Defendants are now
additionally liable for attorney's fees in the amount of Eight Thousand, Ninety-Four Dollars and Thirty-Eight Cents
($8,094.38)
9. By virtue of the foregoing, the Defendants are indebted to the Plaintiff as follows:

WHEREFORE, Plaintiff demands Judgment in the sum of SIXTY-TWO THOUSAND, FIFTY-SIX
DOLLARS AND EIGHTY-EIGHT CENTS ($62,056.88), plus interest thereon from the date of Judgment as
authorized by the warrant appearing in the attached instrument.

The undersigned, Andrew V

Fine and Stella Ann Fine, jointly
and severally, promise to pay to the order of Arthur Nelson, Jr.
the sum of $18,000.00 plus interest at the annual rate of 12%, pay-
ment is to be made as follows:
Four annual principal installments of $2,500.00 each, the
first installment to be paid on or before 1983,
and thereafter on or before of each of the three
succeeding years with a final principal payment of $8,000.00
to be paid on or before 1987. Interest shall
be paid monthly on the unpaid principal balance of the note
at 12% per annum, the first interest payment shall be due on
1982. Upon the breach of any of the foregoing,
Nelson shall have the right to declare that total unpaid bal-
ance immediately due and payable.
The undersigned shall have the right to prepay all or any
part of the sum due at the time provided for the payment of
any principal installment, without penalty, but with interest
to date of payment.
The undersigned hereby empowers any prothonotary, clerk or
attorney of any court of record within the United States or else-
where to appear for the undersigned, and, with or without declar-
ation, to confess judgment at any time or times against the under-
signed and in favor of the holder hereof for the above sum plus
interest thereon from the date hereof, with costs of suit and an
attorney's commission of 15% for collection.
Upon default in paying any installment of principal or
interest and such default remaining for 10 days after written notice
of the default, at the option of the holder of this note, the entire
amount remaining due hereunder, shall immediately become due and
payable. The undersigned hereby releases all errors and expressly
waives all rights to any stay of execution and sequestration of rent and

exemption of any property from levy and sale on execution under any
law of rule of court now in force or hereafter enacted.
The undersigned intend: to be legally bound by the terms
hereof. The undersigned waive protests, demand and notice of non-
payment of this note.
