STIPULATION AGAINST LIENS

THIS AGREEMENT made this /9_ day of '?t?k?" br? 1999, by and between
D. CULLY, INC., D/B/A C & C CONSTRUCTION, A Pennsylvania Corporation,
hereinafter referred to as Contractor,
AND
MARK C. BAILEY AND BRENDA S. BAILEY, husband and wife, hereinafter referred
to as Owner, whereby the contractor undertook and agreed to erected and
construct a dwelling on the certain lot of ground situate in Monroe Township,
Cumberland County, Commonwealth of Pennsylvania, and more fully described
in Exhibit "A" which is attached hereto and made a part hereof known as Lot 17
Lisburn Meadows, Monroe Township, Carlisle, PA 17013.
NOW THEREFORE, THIS AGREEMENT WITNESSETH: That the said Contractor,
for an in consideration of the sum of (S 1.00) Dollar to Contractor in hand paid by
Owner, the receipt whereof is hereby acknowledged, and the further
consideration mentioned in the agreement aforesaid, for itself, himself or
themselves and its, his or their subcontractors, and all parties acting through or
under them, covenant and agree that no mechanic's liens or claims shall be
filed or maintained by them or any of them against the said buildings and the lot
of ground appurtenant thereto for or on account of any work done or materials
furnished by them or any of them under said contract or otherwise, for, towards,
in, or about the erection and construction of the said buildings on the lot above
described, and the said Contractor, for itself, himself or themselves, its, his or their
subcontractors and others under them, hereby expressly waive and relinquish
the right to have, file, and maintain any mechanic's liens or claims against the
said buildings or any of them, and agree that this instrument, waiving the right of
lien, shall be an independent covenant.

same for the purposes therein contained.

undersigned officer, personally appeared Sean Cully who acknowledged
himself to be the Secretary of D. Dully, Inc. d/b/a C & C Construction and that
he as such Secretary being authorized to do so, executed the foregoing
instrument for the purposes therein contained by signing the name of the said
Corporation by himself as such Secretary.

Exhibit A
ALL that certain tract of land situate in Monroe Township, Cumberland County,
Pennsylvania, and more particularly identified as follows:
BEGINNING at a point in the western right of way line of Meadow Lane (a
dedicated 50 feet right of way) at the northeast corner of Lot No. 19 and the
southeast corner of Lot No. 17 on the above mentioned Final Subdivision Plan;
thence along the boundary of said Lot NO. 19 and said Lot No. 17 North 84 degrees
59 minutes 00 seconds West a distance of 350.00 feet to a point in line at the
northwest corner of Lot No. 19 and the southwest corner of Lot No. 17 on the above
mentioned Final Subdivision Plan; thence North 05 degrees 01 minutes 00 seconds
East along lands now or formerly of Charles A. and Donna J. Anke a distance of
262.00 feet to a point at the northwest corner of Lot NO. 17 and the southwest
corner of Lot No. 15 on the above mentioned Final Subdivision Plan; thence by the
boundary of said Lot No. 15, South 84 degrees 59 minutes 00 seconds East a distance
of 350.00 feet to a point on the western right of way line of Meadow Lane (a
dedicated 50 feet right of way) at a point at the southeast corner of Lot No. 15 and
the northeast corner of Lot No. 17 on the above mentioned Final Subdivision Plan;
thence along the western right of way line of Meadow Lane (a dedicated 50 feet
right of way) South 05 degrees 01 minutes 00 seconds West a distance of 262.00 feet
to a point at the southeast corner of Lot No. 17 and the northeast corner of Lot No.
19 on the above mentioned Final Subdivision Plan; the point and place of
BEGINNING.
CONTAINING 91,700 square feet or 2.11 acres, more or less.
BEING Lot No. 17 on the above mentioned Final Subdivision Plan.
BEING the same premises which Kronenberg and Group, by Deed dated April 26,
1999, which Deed is recorded in the Office of the Recorder of Deeds in and for
Cumberland County in Deed Book 198, Page 176, granted and conveyed to Mark C.
Bailey and Brenda S. Bailey, husband and wife.
