STIPULATION AGAINST LIENS WHEREAS, CENTURY 21 PISCIONERI REALTY, INC., (the "Owner"), has executed or is about to execute contemporaneously herewith a contract with MAXIMUM CONTRACTING & CONSTRUCTION, INC., a Pennsylvania contractor, (the "Contractor"), for construction of a single family dwelling (collectively the "Improvements") on a tract of land located on Fortuna Lane, situate in East Pennsboro Township, Cumberland County, Pennsylvania, known as Lot 25 "Jarlin Farm", and more particularly described in Exhibit A attached hereto, incorporated herein by reference and made a part hereof (the "Premises"). NOW, September 20, 1999, before any authority has been given by the Owner to the Contractor to commence work on the Improvements, or to purchase materials for the same, or to enter into any contracts with any subcontractors or material men, or to authorize any purchases by or through any subcontractors or material men, in consideration of the making of said contract with the Owner and the further consideration of One ($1.00) Dollar, to Contractor paid by Owner, and with the intent of all parties to be legally bound hereby, it is agreed that no lien shall be tiled against the Improvements, the Premises, or any part thereof, by the Contractor or any subcontractor, or by any of the material men or workmen or any other person for any labor, or materials purchased, or extra labor or materials purchased, for the Improvements to the Premises (including hereafter changes made thereto), the right to file liens being expressly waived. It is the full intent of the Contractor, for itself and for any subcontractors or material men claiming for themselves, or by, through or under the contract or the Contractor, that the right to file a mechanic's lien, under the provisions of law and/or of Acts of Assembly ill such cases made and provided, for work done or materials furnished in ad about the construction of the Improvements to the Premises is hereby waived. CERTAIN lot or parcel of land situate in East Ponnsboro Township, Cumberland County, Pennsylvania, and being more fully shown and described as LOT 25 on a subdivision plan titled "JarLin Farm" prepared by Joseph N. Body, Engineer & Surveyor (Plan No. C-1287) and recorded in Plan Book 69, Page 63, Cumberland County Records, to wit: BEGINNING at a point on the eastern right-of-way line of Fortuna Lane (50' wide), said point being approximately 368' northerly from the middle of Browns Lane; thence along said right- of-way line, North 33°31138" West, 80.00 feet to a point; thence leaving Fortuna Lane and following along Lot 26 of the JarLin Farm subdivision, North 56°28122" East, 105.00 feet to a point in line of Lot 29 of the JarLin Farm subdivision, thence partly along Lot 29 and partly along Lot 30 of the JarLin Farm subdivision, South 33°31138" East, 80.00 feet to a point; thence along Lot 24 of the JarLin Farm subdivision, South 56028'22" West, 105.00 feet to the point of beginning.
