WHEREAS, Rogene Kepner, of Cumberland County, Pennsylvania, is about to
execute contemporaneously herewith, a contract with Carlisle Mobile Homes of Cumberland
County, Pennsylvania, for the erection of a dwelling upon a lot of land situate as follows:
ALL THAT CERTAIN tract of and situate in North Middleton Township,
Cumberland County, Pennsylvania, more particularly bounded and described as follows:
BEGINNING at an iron pin on the southerly line of a 20 foot right-of-way
leading to the road from Carlisle to Capriva, said point being the northwest corner of lands
now or formerly of Paul R. Myers and of this tract; thence by said lands now or formerly of
Paul R. Myers in a southerly direction 217 feet, more or less, to an iron pin on line of lands
now or formerly of Cloyd Snyder; thence by said lands now or formerly of Cloyd Snyder in
a westerly direction 110 feet, more or less, to an iron pin at corner of lands hereinbefore
conveyed and comer of lands now or formerly of Paul L. Gordon and wife; thence by lands
now or formerly of Paul L. Gordon and wife in a northerly direction 175 feet, more or less, to
an iron pin on the southerly line of said 20 foot right-of-way; thence by the southerly side of
said 20 foot right-of-way in an easterly direction 110 feet, more or less, to an iron pin, the
Place of BEGINNING.
TOGETHER with the use of said 20 foot right-of-way for ingress, egress and
regress between the property hereby conveyed and said public road between Carlisle and
Capriva.
NOW, the -2J 5f day of September, 1999, at the time of and immediately
before the execution of the principal contract, and before any authority has been given by the
said Rogene Kepner, to the said Carlisle Mobile Homes to commence work on the said
building, or purchase materials for the same in consideration of the making of the said contract
with Carlisle Mobile Homes and the further consideration of One Dollar, to Carlisle Mobile
Homes paid by Rogene Kepner, it is agreed that no lien shall be filed against the building by
the contractor, or any subcontractor, nor by any of the material men or workmen or any other
person for any labor, or materials purchased, or extra labor or materials purchased for the
erection of said building, the right to file such liens being expressly waived.
WITNESS, our hand and seals the day and year aforesaid.
