CONTRACTOR
WHEREAS, L & K CONSTRUCTION, INC., CONTRACTOR, has
entered into a contract with Robert J. Gardner and wife Linda A. Gardner,
OWNERS, to provide materials and perform labor necessary for the construction of
a single family residence upon a lot of ground situated in the Township of
Middlesex, Cumberland County, Pennsylvania, and more fully described on Exhibit
"A" attached hereto and made a part of hereof.
NOW, THEREFORE, it is hereby stipulated and agreed by and between the
said parties, as part of the said contract and for the consideration therein set forth,
that neither the undersigned contractor, any sub-contractor or material man, nor any
other person furnishing labor or materials to the said contractor under this contract
shall file a lien, commonly called a mechanic's lien for work done or materials
furnished to the said building or any part thereof; the right to file such liens being
expressly waived on the part of the Contractor and all parties providing labor and
materials under or by virtue of the said agreement(s).
This stipulation is made and intended to be filed with the County
Prothonotary in accordance with the requirements of section 1402 of the Mechanics
Lien Law of 1963 of the Commonwealth of Pennsylvania in such case provided.
IN WITNESS WHEREOF, the aid parties hereto have hereunto set their

EXHIBIT 'A"
ALL THAT CERTAIN lot or tract of ground situate in Middlesex
Township, Cumberland County, Pennsylvania, more particularly shown
on a certain plan entitled Final Subdivision Plan for Donald E.
Mentzer and Shirley M. Mentzer, which plan is recorded in Plan Book
75, Page 133, in the Office of the Recorder of Deeds in and for
Cumberland County, Pennsylvania. Said lot is more particularly
bounded and described as follows, to wit:
BEGINNING at a point on the centerline of dedicated right-of-way
known as North Middlesex Road (T-496); thence along centerline of
dedicated right-of-way of Township Road T-496, South 01 degree 00
minutes 00 seconds East, 350.00 feet to a point) thence along the
boundary line of Lot No. 3 as shown on the hereinabove mentioned
plan of lots, North'84 degrees 25 minutes 00 seconds West, 1172.27
feet to an iron pin; thence along lands now or formerly of Chester
M. Weaver, Jr., North 03 degrees 47 minutes 42 seconds West, 95.82
feet to a point; thence continuing along lands now or formerly of
Nevin B. Fought, at ux, North 04 degrees 25 minutes 38 seconds West,
257.06 feet to an iron pin at boundary line of Lot No. 1 as shown on
hereinabove mentioned plan of lots; thence along Lot No. 1, South 84
degrees 25 minutes 00 seconds East, 1192.44 feet to a point in the
centerline of dedicated right-of-way of Township Road T-496, the
Place of BEGINNING.
BEING designated as Lot No. 2 as shown on the above referenced
plan of lots.
BEING THE SAME PREMISES which Donald E. Mentzer and Shirley M.
Mentzer, husband and wife, conveyed unto Robert J. Gardner and Linda
A. Gardner, husband and wife, by deed dated November 16, 1998 and
recorded November 17, 1998 in thhe Recorder's Office in and for
Cumberland County, Pa. in Record Book 189, Page 304.
