CIVIL ACTION - LAW JURY TRIAL DEMANDED COMPLAINT Plaintiff is The United Telephone Company of Pennsylvania, a business corporation with a principal place of business at 1201 Walnut Bottom Road, Carlisle, Cumberland County, Pennsylvania. 2. Defendant is Streetgard, Inc., a business corporation with a principal place of business at 405 Heisers Lane, Carlisle, Cumberland County, Pennsylvania. 3. On or about November 11, 1997 Defendant executed a Sales Agreement with Plaintiff for the purchase by Defendant of computer hardware and software for the price of $164,232.30. A true and correct copy of the Sales Agreement is attached hereto as Exhibit "A". 4. The parties subsequently agreed to various change orders that reduced the price for the subject computer hardware and software to $152,155.59. 5. The subject computer hardware and software was shipped, delivered and accepted by Defendant. 6. The subject computer hardware and software was never rejected, refused or returned by the Defendant. 7. On or about April 27, 1998 Plaintiff sent Defendant Invoice #CAD29800673 for the purchase price of the subject computer hardware and software in the amount of $152,155.59. 8. Defendant has made the following payments on account of the invoice: $25,000.00 10/08/98 25,000.00 10/27/98 51000.00 21 /99 5.000.00 2/ /99 $60,000.00 9. The present unpaid balance of Invoice #CAD29800673 is $92,155.59, which is past due and owing. 10. Despite repeated demand by Plaintiff, Defendant has failed and refused to make payment of the outstanding balance of its account with Plaintiff in the amount of $92,155.59. WHEREFORE, Plaintiff The United Telephone Company of Pennsylvania demands judgment in its favor and against Defendant Streetgard, Inc. in the amount of $92,155.59, plus interest since May 27, 1998.
