IN RE: INDIRECT CRIMINAL CONTEMPT
ORDER OF COURT
AND NOW, October 6, 1999, 4:13 p.m., the complaint
filed by the North Middleton Police Department against the
defendant alleging indirect criminal contempt of a protection
from abuse order is dismissed. The reason for this dismissal is
two-fold:
1. The original PFA order (or a comparable PFA Order
under New Jersey statutes) was issued in New Jersey and was not
properly registered at the time of the offense within Cumberland
County as required by the PFA statute (see 23 Pa. C.S.A.
6104(b);
2. The New Jersey order was dated December 5, 1996,
and, under Pennsylvania law, PFA orders carry a maximum date of
one year, unless appropriately renewed. The Court feels that a
citizen of New Jersey at the time of the entry of the order
could have no greater rights to enforcement than a fellow
citizen of Pennsylvania in the same circumstances.
