Nieves, an adult individual currently residing at 627 Hoot Owl Road, Boiling Springs, Cumberland County, Pennsylvania. 2. Defendants are Michael J. Nieves, Sr., an adult individual currently residing at 156 A West Penn Street, Carlisle, Cumberland County, Pennsylvania, and Amanda Garland, an adult individual currently residing at 522 3rd Street, Carlisle, Cumberland County, Pennsylvania. 3. The Plaintiff is the paternal grandmother of the child, Kelsey Mae Nieves, bom December 28, 1995. 4. The child was bom out of wedlock. 5. Since birth, the child has resided with the following persons at the following addresses for the following length of time: NAME ADDRESS DATE Anna Nieves, 627 Hoot Owl Road December 1995 to Kenneth Nieves, Boiling Springs, PA .lanuarv 1999 Blair Trump (alternating weeks, at times, two weeks in a row) Amanda Garland Amanda Garland, Amanda's parents (Lonnie W. Garland, Sr., & Nancy J. Garland) Various addresses 3899 Spring Road Shermans Dale, PA lheember 1995 to June 1997 (alternating weeks) June 1997 to sometime in 1999 Amanda Garland 522 30 Street Sometime in 1999 to Carlisle, PA present 6. The natural mother of the child is Amanda Garland, who resides as aforesaid. She is not married. 7. The natural father of the chi Id is Michael J. Nieves, Sr., who resides as aforesaid. He is not married. 8. The relationship of the Plaintiff to the child is that of paternal Grandmother. The Plaintiff currently resides with her son, Kenneth Nieves, age 17, and her fiance, Blair W. Trump, whom Kelsey has always known and held to be her grandfather. 9. The relationship of the Defendants to the child is that of natural Father and Mother, respectively. Michael J. Nieves, Sr., currently resides his one-year-old son, Michael J. Nieves, Jr. and his girlfriend and mother of Michael J. Nieves, Jr., Heather Sheaffer: Amanda Garland currently resides with the child. 10. The Plaintiff has no information of a custody proceeding concerning the child pending in any Court of this Commonwealth. H. The child resided with the Plaintiff, on a biweekly basis, from birth until January 18, 1997, giving the Plaintiff standing under 23 Pa.C.S. Q 5313 to seek partial custody or visitation. 12. The best interest and permanent welfare of the child, who has already established a stable, caring and loving relationship with her grandmother, will best be served by granting partial custody to the Plaintiff so that their relationship can continue to be fostered. 13. The Plaintiff does not know of any person, not a party to the proceedings that claim to have custody or visitation rights with respect to the child. The prior Order of this Court dated November 24, 1999 is temporarily suspended pending the effectiveness of this order. 2. The Paternal Grandmother, Anna M. Nieves, shall have partial physical custody of Kelsey Mae Nieves, born December 28, 1995 on alternating weekends from Saturday at 10:00 a.m. through Sunday at 8:00 p.m., beginning February 26, 2000. The alternating weekend schedule shall continue as long as the Grandmother's husband, Blair Trump, is receiving chemotherapy and radiation treatments on Thursdays or Fridays. Upon termination of Mr. Trump's medical treatment on Thursdays or Fridays, the partial custody schedule set forth in this Court's Order dated November 24, 1999 shall resume. 3. The Paternal Grandmother shall ensure that the Mother is authorized to obtain verification of the ongoing nature of Mr. Trump's medical treatments from the appropriate home care nurses or physicians. 4. The Paternal Grandmother shall provide transportation to and from the Mother's residence for the exchanges of custody under this Order. 5. Counsel for any party may contact the Conciliator to schedule an additional Conference to review the custody arrangements within 60 days of the date of this Order. The pertinent information concerning the Child who is the subject of this litigation is as follows: NAME DATE OF BIRTH CURRENTLY IN Ci1SPODY OF Kelsey Mae Nieves December 28, 1995 Mother 2. A Conciliation Conference was held on February 8, 2000, with the following individuals in attendance: The Plaintiff/Paternal Grandmother, Anna M. Nieves, with her counsel, Thomas S. Diehl, Esquire. Neither the Mother, Amanda Garland, or the Father, Michael J. Nieves, contacted the Conciliator or appeared at the Conference. The Mother's counsel, Lindsay Dare Baird, Esquire, contacted the Conciliator prior to the Conference to advise that she would not be attending as she had not been able to contact her client. 3. The Conciliation Conference on February 81 2000 was scheduled at the prior Conference on November 16, 1999, with all parties in attendance. This Court subsequently entered an Order dated November 24, 1999 reflecting the parties' agreement that the Paternal Grandmother would have partial physical custody of the Child every 4th weekend from Thursday through Sunday. 4. The Paternal Grandmother requested a temporary modification of her periods of partial custody due to the fact that she is transporting her husband from their residence in Boiling Springs to Hershey Medical Center every weekday for chemotherapy and radiation treatments. Until those treatments are completed, the Paternal Grandmother requested that the partial custody schedule be changed to alternating weekends from Saturday through Sunday so that the child would not have to go to the medical appointments which can be lengthy. 5. Based on the temporary nature of the Grandmother's request, the justification for the request, and the fact that neither the Mother nor the Father contacted the Conciliator or appeared for the Conference, the Conciliator recommends an Order in the form as attached.
