(1) I am the Petitioner in the above action and because of my
financial condition I am unable to pay the following fees and

PETITION TO HAULT ACT 84 DEDUCTIONS
And now, this 7th day, of July, in the year 2003, comes the
Petitioner, Mark Spotz, humbly imploring this honorable court to
direct the Pennsylvania Department of Corrections, S.C.I.
Graterford, to immediately hauit all ACT 84 deductions from
Petitioners Inmate Account.
FACTUAL BACKGROUND:
(1) Petitioner was convicted of First degree murder and related
charges, 1995-00794, in 1996.
(2) Petitioner, as part of that sentence, was ordered to pay the
total sum of $14,373.35, by the Honorable Judge Hoffer.
(3) November 1, 2000 the Department of Corrections, S.C.I.
Graterford, began deducting 20% of all incoming money from the
Petitioner's Inmate Account, to collect said $14,373.35 for ACT
84. [SEE ATTACHED EXHIBIT "A"]
ARGUMENT:
(1) Cumberland County never notified the Petitioner regarding any
deductions.
(2) Petitioner, upon becoming aware of the de~uctions, had to
himself contact the Inmate Accounting Office to fin~ out the
source and nature of said 20% deductions.
(3) Inmate Accounting Officer, Patricia Croll, at this time,
informed Petitioner that the deductions were for costs, fines,
restitution for Cumberland County case no.: 1995-00794.
(4) There was never an Order from

(5) The monies in Petitioner's Inmate Account are private
property per EOLLOWA¥ ¥. LEHMAN, 671 A.2d 1179 (Pa.C~wlth.1996):
"this court stated that the money in an
inmate's personal account is private property
that the government cannot take without due
process."
(6) This Honorable Court never sent the Petitioner a I]otice
ordering him to pay, therefore, the Petitioner has not defaulted
under 42 Pa.C.S. § 8127(a).
(7) This Honorable Court has not held the proper "action or
proceeding" under section 9730(b) of the Sentencing Code, to
determine the Petitioner's ability/inability to pay.
(8) The 20% Act 84 deductions from Petitioner's Inmate Account
creates a financial burden that Petitioner is u~able to afford.
(9) This Honorable Court needs to hold a proper "action or
proceeding" to determine the Petitioner's ability/inability to
pay the $14,373.35, before the deductions can be taken.
(10) The controlling case law on this issue is BOOFER ¥. LOTZ,
797 A.2d 1047.
(11) The trial court is required to make a determination of the
Petitioner's ability to pay court costs, prior to ordering a 20%
deduction from Petitioner's Inmate Account to satisfy those
costs; a hearing is necessary to determine whether the
Petitioner's earnings have already been attached for purpcses of
alimony, child support, or other debts, and the Clerk of Courts
has no statutory authority to request 20% or any other amount as
an installment payment. 42 Pa.C.S.A. §§ 8127(a), 9728(b), 9730(b)
(12) The current 20% ACT 84 deductions from Petitioner's Inmate
Account are illegal, violating Petitioner's due process rights.

Pa.R.D.J. 1008 B states, "When an appeal is fi.om a judgment for the possession of real property, ... and
thereafter, deposits cash or bond with the prothonotavj in a sum equal to the monthly rent which becomes due
during the period of time the proceedings upon appeal are pending in the court of common pleas, such
additional deposits to be made within thirty (30) days following the date of the appeal, and each
successive thirty (30) day period thereafter.
