Plaintiff is an adult individual who resides at 127 North Middlesex Road, Carlisle, Cumberland County, Pennsylvania, 2. Defendant Is an adult Individual who resides at 6508 Birmingham Place, Harrisburg, Dauphin County, Pennsylvania, 3. Plaintiff engages In the business of auto body repair. 4. On or about May 24, 1999, at Defendant's specific request, Plaintiff agreed to repair Defendant's 1994 Mercedes Bonz automobile. 5. Plaintiff agreed to pay and Defendant agreed to accept payment for the work performed by Plaintiff on the basis of labor and materials as determined by Defendant's Insurance adjuster in the Initial amount of $0,017,14. 6. Al Defendant's special request, Plaintiff upgraded a tire for the vehicle for an additional $42,91 so that the entire project cost rose to $6,960.05. 7. In the course of the repairs, authorization for additional repairs were given by the insurance company In the amount of $694.12 and $315.67. Defendant or his Insurance company paid to Plaintiff $7,009.79. 10. On or about July 1, 1999, Defendant Inspected the vehicle and made a final payment of $941.54. After leaving with the vehicle, Defendant Immediately stopped payment on said check. 11. Despite demand, Defendant has failed or refused to pay the balance due and owing of $960.05.
