Andes, and amends her original Complaint In Custody and petitions the Court for the entry of a custody order, based upon the following: 1. The Plaintiff herein is Theresa C. Stopfel, formerly Theresa C. Keller. Her name changed as a result of her marriage to the Defendant on 3 June 2000. Her address remains 1026 Swarthmore Road, New Cumberland, Pennsylvania, 17070. 2. The Defendant in this matter is still David E. Stopfel. His current address is 313 Hummel Avenue, Lemoyne, Pennsylvania, 17043. 3. The parties hereto are husband and wife and are the parents of two children born to them, Nolan M. Stopfel, born 24 June 1997, and Anna L. Stopfel, born 4 January 2000. Plaintiff seeks an award of physical and legal custody of both children. 4. Both children were born out of wedlock but were subsequently legitimatized by the marriage of Plaintiff and Defendant, who are the biological parents of both children. 5. Plaintiff seeks custody of the minor child, Nolan M. Stopfel. 5. The child was born out of wedlock and is presently in the custody of the Plaintiff and Defendant. 7. The father of the child is the Defendant who resides at the address set above. 9. The mother of the child is the Plaintiff who resides at the address set above. 10. The Plaintiff is the natural mother of the child. Plaintiff currently resides in a single family residence at 1026 Swarthmore Road in New Cumberland, with the minor child and with her four children by a prior marriage, who live there approximately 50% of the time, those children are Rachel Keller, age 19, Laura Keller, age 16, Jennifer Keller, age 14, and Justin Keller, age 11. 11. The Defendant is the natural father of the child. The details of the Defendant's living arrangements are not known at this time. 12. The Plaintiff has not participated as a party or in any other way in any litigation concerning the custody of the child in this or any other Court. The Plaintiff has no information of a custody proceeding concerning the child pending in a Court of this or any other jurisdiction. Plaintiff knows of no other person not a party to this action already who has physical custody of or claims to have custody or visitation rights with the said child. 13. The best interests and permanent welfare of the child will be served by granting the relief requested by Plaintiff for the following reasons: A. The Plaintiff has been the primary care provider for the child since the child's birth; and B. The Defendant has an acute alcohol problem which prevents him from being able to care properly for the child; and C. The Defendant is not sufficiently responsible to properly care for the child and to provide for the child's needs; and D. An award of custody to Plaintiff will continue the child in the family situation in which he has lived all of his life. 14. Each parent whose parental rights to the child have not been terminated and the person who has physical custody of the child have been named as parties to this action.
