Severino and Julie A. Severino, of Cumberland County, Pennsylvania (herein "Owner") is about to execute contemporaneously herewith, a contract, with Northern Construction Associates of Cumberland County, Pennsylvania (herein "Contractor"), for the construction of a building upon Lot No. 12, Allen Estates, Lower Allen Township, Cumberland County, Pennsylvania, more particularly set forth on Exhibit "A" attached hereto and made a part hereof. NOW, October 74 1999, at the time of and Immediately before the execution of the principal contract, and before any authority has been given by said Owner to the said Contractor to commence work on the said building, or purchase materials for the same in consideration of the making of the said contract with Owner and the further consideration of One ($1.00) Dollar in hand paid to Contractor by Owner It Is agreed that no lien shall be filed against the building by the Contractor, or any sub- contractor, nor by any of the material-men or workmen or any other person for any labor, or materials purchased, or extra labor or materials purchased for the erection of said building, the right to file such liens being expressly waived. Severino CONTRACTOR: Northern Construction Associates -r ,I i SCHEDULE C ALL THAT CERTAIN tract of land Situate in Lower Allen Township, Cumberland County, Pennsylvania and described according to a Final Subdivision Plan prepared by Hartman and Associates, Registered Professional Engineers, Camp Hill, Pennsylvania, dated November 1, 1995 and last Revised February 6; 1996 and recorded in Plan Book 72, Page 125, as follows to wit: BEGINNING at a point on the northwest side of Wellgate Lane and a comer of Lot No. 11 on said plan; thence extending along said lot North 85 degrees 15 minutes 00 seconds West 258.91 feet to a point In line of Lot No. 16 on said plan; thence extending along said lot South 19 degrees 16 minutes 55 seconds West 92.15 feet to a point a comer of Lot No. 13 on said plan; thence extending along said lot South 57 degrees 14 minutes 57 degrees East 268.58 feet on the northwest side of Wellgate Lane; thence extending along said lane along a curve to the left having a radius of 170.00 feet the arc distance of 133.07 feet to a point of tangency; thence continuing North 04 degrees 45 minutes 00 seconds East 94.10 feet to the point and place of beginning. BEING Lot No. 12 BEING THE SAME PREMISES which Banzer Corporation by Deed dated January 3, 1996 and recorded In the Office for the Recording of Deeds in and for Cumberland County in Deed Book 137 Page 614 and conveyed unto Penn Valley Corporation, a Pennsylvania corporation.
