THIS AGREEMENT made this 1311` day of Q oc ??--f, 1999, by and
between CUMBERLAND DESIGN & BUILDING COMPANY, INC., a Corporation,
hereinafter referred to as Contractor,
AND
AQUA TREATMENT SERVICES, INC., a Corporation, hereinafter referred
to as owners, whereby the contractor undertook and agreed to
erected and construct a dwelling on the certain lot of ground
situate in Silver Spring Township, Cumberland County, Commonwealth
of Pennsylvania, and more fully described in Exhibit "A" which is
attached hereto and made a part hereof known as Lot #2, 194 Hempt
Road, Mechanicsburg, Cumberland County, PA.
NOW THEREFORE, THIS AGREEMENT WITNESSETH: That the said
Contractor, for an in consideration of the sum of ($1.00) Dollar
to Contractor in hand paid by owner, the receipt whereof is hereby
acknowledged, and the further consideration mentioned in the
agreement aforesaid, for itself, himself or themselves and its,
his or their subcontractors, and all parties acting through or
under them, covenant and agree that no mechanic's liens or claims
shall be filed or maintained by them or any of them against the
said buildings and the lot of ground appurtenant thereto for or on
account of any work done or materials furnished by them or any of
them under said contract or otherwise, for, towards, in, or about
the erection and construction of the said buildings on the lot
above described, and the said Contractor, for itself, himself or
themselves, its, his or their subcontractors and others under
them, hereby expressly waive and relinquish the right to have,
file, and maintain any mechanic's liens or claims against the said
buildings or any of them, and agree that this instrument, waiving
the right of lien, shall be an independent covenant.

EXHIBIT "A"
ALL THAT CERTAIN tract or parcel of land situate in Silver Spring
Township, Cumberland County, Pennsylvania, more particularly
bounded and described as follows, in accordance with a Plan of
Robert D. Shaffner recorded in Plan Book 35, Page 20, Cumberland
County records:
BEGINNING at a point on the center line of Hempt Road (L.R. 21018)
at a corner of Lot No. 3, said point beginning being measured along
the said centerline of Hempt Road from its point of intersection
with the center line of Texaco Road,'the distance of 626.29 feet;
thence extending from said point of beginning and along the said
center line of Hempt Road, South 38 degrees 09 minutes 13 seconds
East, the distance of 150 feet to a point at a corner of Lot No. 1;
thence extending along Lot No. 1, North 47 degrees 22 minutes 12
seconds East, the distance of 430 feet to a point at a corner of
Lot No. 1; thence extending along Lot No. 1, North 38 degrees 09
minutes 13 seconds West, the distance of 1S0 feet to a point at a
corner of Lot No. 3; thence extending along Lot No. 3, South 47
degrees 22 minutes 12 seconds West, the distance of 430 feet to the
first mentioned point and Place of BEGINNING.
BEING shown as Lot No. 2 on the above-mentioned Plan.
BEING the same premises which Cumberland County Industrial
Development Authority, by Deed dated June 1, 1987, which Deed is
recorded in the office of the Recorder of Deeds in and for
Cumberland County in Dead Book 32-S, Page 1090, granted and
conveyed to Aqua Treatment Services, Inc., Borrower herein.
