RINE & RINE BUILDERS, a Pennsylvania contractor No. -3up D STIPULATION AGAINST LIENS WHEREAS, BERNARD A. PINCKNEY and SHELLEY D. PINCKNEY, (the "Owner'), have executed or are about to execute contemporaneously herewith a contract with RINE & RINE BUILDERS, a Pennsylvania contractor, (the "Contractor'), for construction of a single family dwelling (collectively the "Improvements") on a tract of land located on Fish Hatchery Road, situate in North Newton Township, Cumberland County, Pennsylvania, known as Lot 23, Fish Hatchery Rd, Newville, PA, and more particularly described in Exhibit A attached hereto, incorporated herein by reference and made a pan hereof (the "Premises"). NOW, October 7, 1999, before any authority has been given by the Owner to the Contractor to commence work on the Improvements, or to purchase materials for the same, or to enter into any contracts with any subcontractors or material men, or to authorize any purchases by or through any subcontractors or material men, in consideration of the making of said contract with the Owner and the further consideration of One ($1.00) Dollar, to Contractor paid by Owner, and with the intent of all parties to be legally bound hereby, it is agreed that no lien shall be filed against the Improvements, the Premises, or any part thereof, by the Contractor or any subcontractor, or by any of the material men or workmen or any other person for any labor, or materials purchased, or extra labor or materials purchased, for the Improvements to the Premises (including hereafter changes made thereto), the right to file liens being expressly waived. It is the full intent of the Contractor, for himself and for any subcontractors or material men claiming for themselves, or by, through or under the contract or the Contractor, that the right to file a mechanic's lien, under the provisions of law and/or of Acts of Assembly in such cases made and provided, for work done or materials furnished in ad about the construction of the Improvements to the Premises is hereby waived. Foote, Sr. and H. David Miller, Jr., as recorded in Cumberland County Plan Book 67, Page 59 C, as follows: BEGINNING at a point in the center line of Fish Hatchery Road, Township Road T-388, at corner of Lot No. 24 as shown on the above described subdivision plant thence by the centerline of Fish Hatchery Road, South 31 degrees 21 minutes 20 seconds East, 201.32 feet to a point at corner of Lot No 22 as shown on said plan, now or formerly of Wilmer D. Hefflefinger and Chloe O. Hefflefinger, husband and wife; thence by Lot No. 22, South 58 degrees 38 minutes 40 seconds West, 406.06 feet to a point in line of land now or formerly of Paul O. Dyarman; thence by said land now or formerly of Paul 0. Dyarman, North 46 degrees 11 minutes 57 seconds West, 208.27 feet in point in line of said land at corner of Lot No. 24 as shown on said plant thence by Lot No. 24, North 58 degrees 38 minutes 40 seconds East, 459.42 feet to a point , in the center line of Fish Hatchery Road, the point and place of BEGINNING.
